I've got a really really really good idea on how to prevent these kinds of issues...pass a new law:
Any bank that mistakenly forecloses on any property has to compensate the wronged party by repairing any/all damage to the house and its contents and ***paying 100% of the mortgage that is (or was most recently) on the house*** including taxes/fees/etc.
Failure to pay in a timely fashion will result in your interest rate defaulting to a variable APR of 29.99% plus prime.

I would go one step further, and I would say the penalty should be 200% of the value of all assets seized. Because what if there is no mortgage? And then 1000% the value of any pets seized.

Why is BofA paying only some of the damages. They should be paying all of the damages. If BofA were a single person, they should have been drawn and quartered long ago. How can companies act with such impunity?
They'd be in jail for trespassing, breaking & entering, criminal destruction of property & criminal mischief. This is why giving corporations citizenship was a horrible idea.

Because it was a contractor that actually did the breaking of the law. It would be like jailing the president for the crimes Halliburton committed. BoA just said hey we need this house's locks changed and we need it winterized. Snyder Property Services was the ones that broke the law, and more specifically the guy they subcontracted did it.
BoA also broke the law if the contractor did. After all when you are a boss and you tell your underlings to go break the law there are plenty of laws that person just broke.
That's like hiring a hitman for a murder and claiming you didn't do anything wrong. I think responsibility must be taken for the actions of subcontractors, by both the government and corporations.
No it's more vague than that. It's like saying this person owes you some money and the person you hire says they are going to take care of it. Then that person hires a hitman. The hole point of the subcontractor bit is to reduce liability, \"I didn't know he was going to hire a hitman.\" \"I didn't know they had foreclosed on the wrong house.\" I know I work as a subcontractor, although because I don't want my E&O rates to go up I am sure about the houses I inspect.

There are four of these cases I currently have google news alerts setup for.
2 in Vegas, the first one was settled for 2.3 million, the 2nd they offered 5k, the owner asked for 200k, case still pending.
1 in Chicago, still pending.
1 in South Florida still pending.
All of them against BofA.

They should sue BofA for animal abuse, among other things. BofA doesn't really give a s*** about customers of any kind. Repair \"some\" of the damages? Ha They should repair everything and pay punitive damages. I'd suggest 5 million.
I imagine she might see treble damages or what is likely BoA will offer her the old we'll give you your repair bill + X amount of dollars (like 20 or 30 thousand) and you sign a nondisclosure agreement or we will spend the next 3 years filing motions make it cost hundreds of thousand of dollars to fight us.

I have a hard time wrapping my head around this colossal blunder made by Bank of America and/or its contractor. This sounds like a plaintiff's lawyer's dream case.

This one is not a case of entering the wrong address, they seem to have foreclosed by mistake. They apparently didn't serve her with the appropriate notices in which case she would have recognized ahead of time there was an issue. The bank is clearly at fault, but I would think that a sheriff needs to be present -- why isn't the sheriff being sued?
Something tells me the owner may have had problems other than \"one missed payment\". Either she got notices and ignored them, or the sheriff is completely incompetent

How about every time this happens going forward, a Bank of America officer is randomly selected to receive the same treatment? This poor lady took a random bullet, so fair is fair. I'd love to hear the follow up on this, I hope the judge goes absolutely medieval on BOA's worthless, pathetic ass.

OK BOA, you win the Golden Poo award already. You can stop this nonsense. It's comical now at all the B.S. BOA is doing. I was keeping a list of their shenanigans, but they keep repeating the same ones over and over. They've already foreclosed on several other homes where they didn't hold the mortgage. I'm tempted to take out a real mortgage with BOA, not pay and when they attempt to foreclose, try to persuade a judge that this is yet another case of BOA trying to foreclose on someone with whom they have no actual mortgage. BOA must think that $65 fees are not enough money when they can foreclose and get hundreds of thousands of dollars at a time. Sure, a few people will fight back, but heck, it's worth it.
If we started shooting these scumbags out of cannons & into space, this shit would stop.

It's sad that this keeps happening and nothing is done about. I can maybe understand it happening in extremely rare cases but it seems BofA seizes a house more frequently than I have bowel movements.

That would be great, except, as far as we know, NOBODY who Bank of America has done this to (at least 5 people at this point) has been taken care of by Bank of America. In fact, Bank of America tries to maintain it has done nothing wrong. Correct me if I'm wrong, but I have heard nothing, no updates at all, on any of the previous Bank of America \"foreclosures\".
It will probably take a year or two for these to come to trial.

Now that's something to SQUAWK about.
As someone who does inspections for Bank of America, CitiBank, Navy Federal, ETC I can tell you exactly how they make this mistake. The bank pays a property preservation group who then subcontracts out the inspections to make sure the house is in good shape and to double check to make sure they have the right house, the problem is that the subcontractors (in this case in Pittsburgh but in my case Virginia) are paid per house they do, so most of the time everything is correct, but sometimes the subcontractors do not catch a mistake like 307 forclosure court is not the same as 307 forclosure street. For this reason BoA will probably eat this lawsuit and then sue the property preservation firm, who will then sue the subcontractors who then have E&O insurance which ultimately takes the hit. The person who contracts me was told the right house, the inspector said it was the right house the HOA said it was the right house and when they popped the lock and cleared it out, turns out wrong house. Luckily her E&O took the fall for her or she would have been down $58,000.
LAWYER UP! How many people need to go through this? Hell, find all of these people and go class action!

Very simply the people who make these \"errors\" by not thoroughly checking their data and making absolutely certain they are correct before taking action need to start seeing some very serious time behind bars on a regular basis.
That's the biggest problem allowing this to happen: The people doing it are not held accountable, and that needs to change drastically.

this kind of crime requires intent. Its a screw up of monumentally proportions but its not a criminal act per say. IANAL but t this point i would sue for 300% damages for the fact that BoA has done this so many times recently they are apparently not doing anything to stop the screw ups.

I've been planning on getting my car refinanced for a better rate, and I know where I'm not going. I'm a responsible debtor who makes his payments on time and wants to keep his car- so I'm not really BofA's \"type\".
Some advice, take your money out of large corporate banks, place it in local credit unions, with a long history of stability. The only way BoA will listen is if they go broke...

If anyone came in my house and took my possessions, animals, etc. I'd track them down and get EVERYTHING back that very day. Those individuals would have an EXTREMELY bad day - guaranteed. They'd bring everything back, put it all back in the house as it was, and THEN I'd sue everyone involved. Based on the sheer amount of these F'up's on the behalf of BoA, I'd make it my life's work to see to it that the Attorney General had someone brought up on criminal charges.
I fully agree with some of the other commenters - any bank pulling this shit should be responsible for paying off the mortgage, all taxes, fees, fines, payments, etc for whatever is related to making that person whole and returning their property to them again, remedying all damages to the 100% satisfaction of the person who got screwed over, and whatever else I could dream up that they cost me.
Seriously - what does it take to actually verify that you're at the correct address with the correct property PIN, GPS coordinates, etc? What about NOTICE before tossing the person's house?
The CEO of a corporation that commits a crime needs to be held liable for his companies actions. They get paid the big bucks because they say that their is a limited pool of people able to manage such a large organization. When their management of the company fails, and it leads to a crime being committed they need to held accountable.

As a former customer of BOA who took their abuse and general apathy for WAY too long, I am still trying to make up for financial losses incurred as a direct result of BOA's stupid policies (They allowed someone to steal 700.00 from my checking account, then refused to file a fraud claim, even after being given a police report AND being threatened with litigation), and quite frankly would encourage this woman to stop talking to them AT ALL... hire a lawyer and sue them into penury.

They don't need to learn anything. No one is going to stop them from doing whatever they want, whenever they want. I'm not a fan of lawsuits but in this case I hope BoA pays through the nose. That said, however, I have no confidence they will have \"learned\" anything from this. They make FAR too much profit running roughshod over people, to bother worrying about the occasion or two when a lawsuit makes them pay up.
And the government regulators are generally too well hooked into the banks, to depend on them to do anything. There's a non-stop revolving door between the regulating agencies, the banks themselves, and lobbyists for the banks ... people go from one to another, then the other, and back again, freely. The regulators thus have no incentive to actually want to do anything detrimental to the banks.
I hate regulation as much as the next business owner, but until BofA faces some kind of punishment for this kind of error, they will continue to let them happen.

We learned that if this happens to you that you're more or less ****ed. Good luck getting the banks to pay for your time, suffering or stress, or even the damages they themselves created... unless you get a lawyer, and even then they'll only do the bare minimum to rectify the situation.
