In the context of the scrip for breast milk, I think that Cuddy was trying to allude to the fact that even with a scrip, the insurance would not pay for it. But, since it is now prescribed by a doctor, I believe that you can write it off on your taxes as a medical expense.

true enough, i just spent 7 months trying to get a prescription filled. BCBS kept finding ways to not pay for it.
actually it was only HALF a prescription - they paid for the medical appliance but not the accessories to make it useable.

i still had to get a letter of medical necessity from my doctor so they would approve the prior authorization, even when it was covered by policy i had to prove i was 'sick enough' to need it

I heard a story about a cancer survivor that wanted thalidomide as a treatment. It is, of course, experimental in that field, and generally something insurance will never pay for after it was virtually banned nationwide due to birth defects. Being a man, of course, it has no chance of causing such things, but that's besides the point.

He worked as an insurance claims adjuster himself, and knew how to convince his insurance. After being denied, he found the most expensive cancer treatment that would be covered by insurance and convinced the doctor it was right for him, and got the same go ahead for thalidomide treatment. He calculated the total cost for both treatments. He then wrote the insurance company a letter giving them the option to either approve the thalidomide treatment, otherwise he will have the expensive treatment on their dime.

They decided to approve his thalidomide treatment.

BTW: This was in Canada, where healthcare is \"free\", and this was my friend's to-be Father-in-Law, so I'm quite certain it is true. He's still alive using the thalidomide treatment, btw.

Its the same mentality as my insurance provider only not on as extreme a level. Most of my hobbies/ recreational sports have a very high risk of knee injury, to the point I keep my orthopedic surgeon's office number on my speed dial (no joke its #8). To put it mildly, its not a question of if I need recronstructive surgery its a matter of when. My provider would rather wait to pay for the surgery (I would have it done by the same surgeon as Tiger Woods went to, he's an approved provider why not), all of the associated physical rehab, and the custom orthopedic sports knee braces instead of just paying for the knee braces ahead of time. Can someone explain to me how this makes sense...

First, it seems to be about private care (arguments based on a claims-adjuster's view are likely to fall flat with public insurance, since... well, I can't find any evidence that any province employs claims adjusters for health care), and uses that to condemn the public system. Second, it conveniently fails to mention that the drug the guy was asking for is, by the manufacturerr's own choice, not even legally approved for sale in Canada. Also: To be fair, I should mention that there is an access program that doctors can use to prescribe and get thalidomide in Canada. But... well, big surprise, insurers get hinky about covering things that have a horrible track record and are illegal through most channels.

Where has anybody ever said healthcare is all free up here? Medically necessary hospital procedures arecovered, by law. Other things vary by province and the exact item you're asking about - cosmetic surgery, for example, is pretty much never covered, and medication coverage outside the hospital varies widely. You can buy private, supplemental insurance, and that's what it sounds like your FOAF was doing. Equating it to the medicare system is just plain bullshit and you know it.

They are hoping by the time you need the expensive surgery you will be on some other insurance plan due to something changing in your life or employment. I can't remember what they call it for sure, dumping maybe? But it is an industry standard tactic.

My insurance wouldn't pay for a simple outpatient procedure I needed on my back that all told cost less than $1000. But they would fork over about $5000 a month for a couple of years for physical therapy, doctor appointments and pain meds. I finally got the funds together and paid for the work in cash and can walk normal again. BTW, the problem prevented me from working on top of it.

I had the opposite experience. My insurance company, speaking thru their mouthpiece (my pcp), decided I should have surgery to correct what could be regulated thru lifestyle changes (diet, mostly). Fortunately, the surgeon whom I saw in the ER advocated for me, and 15 years later, I've never had an issue since.

I live in Canada and have been denied by an insurance company myself. Do you seriously believe that in Canada health insurance either doesn't exist or that the government/insurance companies are forced to give you all treatments a doctor recommends?

In my case, of course, it was only for a root canal, and it was only on the dentist's recommendation, not a doctor's, so it didn't exactly break me to pay for it out of pocket.

In Canada you have to have a guarantor who has known you for two years and holds a valid passport sign both your application and pictures verifying that you are who you say you are and that is a picture of you. You also have to have two references who have known you for two years. The rules changed a few years ago; I'm not sure what they used to be.

Exactly. When it comes to cancer treatments (Which, unfortunately, my wife's family knows far too much about!) only very basic treatments are covered by Health Canada, and many of them will require you to visit a cancer specialist hospital. For my brother-in-law, and father-in-law, and uncle-in-law (does that count?) that meant that for free treatment, they had to, weekly, drive from Guelph to Hamilton, ON. My father-in-law and brother-in-law have recovered just fine. The free treatment has been rather poor for my uncle, who is on his third round in 10 years or so. I believe an alternative (Read: Not covered) treatment would probably get rid of his cancer, but all of us don't have enough money to pay for one. Insurance would probably cover it, but he doesn't have any (Yes, in Canada most people purchase, or are provided, extended health insurance by their employer to fill in the gaps in free healthcare).

If you have a tough-to-beat cancer, and want any sort of specialized treatment, you also will quickly find the government doesn't cover it.

Of course, you don't have to take my word for it, take the government's.

Ontario cancer patients who were once forced into mortgaging their homes or emptying savings accounts to pay for an effective but pricey drug have just had provincial coverage extended.

That sounds like the US, no? Of course, it's far less frequent in Canada, which is why most uninformed Canadians think their fortune is bulletproof when it comes to the best healthcare in this country.

Things have improved, but only for Ontarians. And still, not all treatments doctors recommend are covered even after these changes.

I also have 3 relatives who've been treated for cancer in Ontario - with no complaints about the quality or timeliness of their treatment.

What type of private insurance covered the thalidomide treatment? Most private insurance in Canada is an employee benefit with limitations that only covers 'add-on' type benefits - dental, fertility treatments, private rooms, prescription plans etc... I've never heard of an employee plan that would force the insurer to cover thalidomide type treatments.

It didn't force them to include thalidomide treatments, but it did require them to pay for his cancer drugs. The cancer drugs the doctor approved that weren't thalidomide and were on the approved list for the insurance company were very expensive, so his letter helped convince them to save money by making an exception for him (and, of course, help him, but that doesn't matter to insurance companies).

I'm not sure what insurance plan it was, or what the drugs were the doctor approved, to be honest. I just know that cancer drugs (which, in itself, is the therapy if they're simply pills) can be exceedingly expensive. This is one of those things I try to avoid discussing with friends, so I probably won't find out, sorry.

I don't think the show was advancing the idea that Mr. Acevedo wouldn't win his case. Many of last night's story lines were about Dr. Cuddy's negotiation skills. In this instance, she was able to get the plaintiff's attorney to bring his client into her office so she could convince him not to pursue the case. If she thought the hospital had a winnable case, she wouldn't have done that.
As for the breast milk prescription, Dr. Cuddy told the patient his insurance wouldn't cover it and refused to prescribe it.

As an aside, I have to say that a website devoted to questioning the medical errors of a tv show cries out for someone to tell this person to get a life. As a lawyer, I could point out all kinds of errors on any number of lawyer shows but I don't because it's a TV show.

As a physics major, I have a \"that is not remotely correct\" TV moment about 90% of the time I'm watching a show, the other 10% consisting of animated content.

Now that I'm in law school, a lot more of these issues are coming to bear.

Specialized knowledge will often lead to painful moments when watching television, but I would posit that no discipline leads to more of these moments than a basic understanding of the physical world.

Isn't it a charity hospital? Which means that the government supplements/pays for treatments (or get your credit ruined!). Therefore the ER is used as a regular Dr visit, or the characters wait until the last possible minute to get treated by House. After all, he has to have received some media attention by now.

Princeton-Plainsboro is presumably it is funded from private parties and trustees.

Despite the fact that the aerial view of the hospital used in the opening credits is of a building at Princeton University, the hospital refers to the town of Princeton and Plainsboro, and has nothing to do with Princeton because Princeton does not have a medical school. Because there's no presumed association, the hospital would not receive any help from the government for education.

Really? We're going to focus on informed consent now? Six seasons into the show? Informed consent left the building, oh, six seasons ago. (Case, point, season three episode Informed Consent, which I routinely use when teaching to drive home the point of Things To Not Do, Thank You Very Much.)

Regarding breast milk as an experimental treatment, Scott over at PolitieDissent is wrong. Whether or not an insurance company will pay for experimental treatments is a variable dependent on insurance companies and their agreements with whomever is running the experimental protocol. While you can't jump straight to an experimental treatment, if it's your only option, many (if not most) companies will approve the treatment - you will just have to appeal in order to be seen by human beings who can make such magic happen. (This, by the way, is why there are people called health care advocates - their job is to make these things, that many patients and doctors don't realize are options, happen.)

I've seen only one episode of House. In it, he orders one of his lackeys to perform a colonoscopy on a patient without anesthetic. I bet the insurance company was okay with that procedure.
