I have to disagree with that, because when it comes to Black Friday stores tend to get exemptions with the law or outright assistance from police. How many Wal-marts nationwide had a police presence? Black Friday is something of a cultural phenomenon, and while it doesn't excuse abuse of the law, things are so hectic on the day what are you to expect?

If they had employees out there directing customers you should have reasonable assumption they've got some backing to do what they're doing on a day like today.

I disagree that stores get exemptions from the law on major shopping days. Having a police presence doesn't mean anything as far as whether or not rules and laws are being bent and/or broken.

There was an article in the NYT today that the city missed out on about $1,000,000 in parking ticket fees because today was actually a holiday, when it usually isn't. In years past, black friday has been a huge money-maker because of the parking tickets. And don't think other, smaller municipalities don't salivate at the thought of all that extra income from shoppers too distracted to pay attention to parking regulations. I know my parking officers were out in full force today - I only saw two of them stop by the office all day, and that is very unusual.

Okay....let me get this straight...you didn't look for a sign? Because I don't think there is anyplace in the country that enforces parking violations without signs. My advice: Read the signs. Macy's employees and Macy's stores cannot offer free parking on streets owned by a City.

Actually Yes they can. Even been to a bar or club that offers Valet?? If you look nearby their place there are normally meters tht have been confiscated and used for this. Its up to the club if they wanna charge you for that spot, but in essance they can give the spot to you for free.

Many times if the store was smart enough they would have worked ith the city and arranged for those spots to be reserved (paid in advance by Macys im sure would be required). But It could have happend. And I could have a talking dog fly out my butt for xmas, well see. :)

Actually, the whole reserved spots thing is illegal in most areas of the country, despite it being a rampant problem. D.C. might be different, but I doubt it. I can't see how that would benefit the city. In LA, for example, they send out police specifically to locate and remove fake signs placed around the city designating public parking spots for businesses.

Clubs in Dallas will do this as well. They will take over normal no-parking spots and charge patrons to valet park there. The police pretend not to notice.

I would also add to the other comments that D.C. sometimes does this helpful thing where they have conflicting signs on the same post. Whether or not that's the case at this Macy's (I don't know, I've never been to that one) I would not be surprised in the least.

But at least the District made some money today!

Exactly. I've lived next to D.C. for four years, been going into the city on almost a daily basis for two, and I STILL can't explain half the signs to you.

I intentionally park in garages half the time just because even though they're four times as expensive, there's an attendant I can ask questions (at least, sometimes).

Absolutely there are. Some cities (Milwaukee comes to mind) enforce year round night parking restrictions, that is, you need a permit to park on any city street from 1 AM until 5 AM every night. Also, there is alternate side parking in effect year round. The alternate side parking isn't posted anywhere, and the permit requirement is only on certain freeway off ramps.

Washington DC parking is actually a special kind of bizzaro insanity-land. Even NYC makes more sense and has more leniency (and I'm speaking as someone who received a parking ticket from the Bronx... while the car in question was verifiably in Rhode Island. And who lived in Brooklyn at the time, to boot). There may not have been a handy sign -- I've only been to that Macy's by Metro -- and it was also an odd day, where I can see why there would be confusion over \"rush hour.\"

I used to work at the McGraw Hill building across from the Macy's Building at 12th and G st in D.C. There literally is nowhere to park there, and people who got tickets should have paid better attention to traffic laws. Only police officers are allowed to override any traffic signs or signals. And if I can recall correctly, the signs in front of this Macy's specifically state no parking during rush hours, and 2 hour parking any other time. In my opinion Macy's should only be held responsible for the employees encouraging people to park illegally, and nothing more.

Living in DC, let me say this:

There are big red \"NO PARKING\" signs with times on them that say when and where you may park.

There's a huge detail missing from this story, and one that would make a big difference in how it comes out: the time this person got to the store. Macys opened at 5 am in Washington today; the parking restrictions go into effect at 7 am, meaning that the employee may have been 100% right that there was no issue parking in that location - until the 7 am hour.

I'm not one to usually blame the OP. Without the time they parked, however, it's hard to know whether the employee was actually wrong or not, or if the OP simply parked too long.

By the way, the OP is lucky that the city didn't *tow* his car off 12th street (a major commuter route). The towing fee is $100 alone, and you have to pay the towing fee and the ticket on the spot (you can't even contest it).

Thanks for clarifying the parking laws in DC. I was wondering about the time they park too. I assumed that there was a special \"rush hour\" time when the no parking thing went into effect. If the OP parked before 7am, the this could be the case. However the OP also said that when he went back to the car, there was tall dark-haired man from Macy's still saying where this is two-hour parking on 12th street. So basically the rush hour no parking law was still in effect probably when the OP came back out, and there is still a Macy's employee directing people to get parking tickets.

I agree that the OP should pay attention to the parking signs and not trusted the Macy's employee. On the other hand though, Macy's should do something for the OP since the OP had a reasonable expectation that Macys employees would not be telling him to park somewhere illegal. Maybe a $50 gift card is in order since the blame can be spread equally between Macys and the OP?

Unfortunately DC's parking areas are inconsistent from block to block. It's entirely possible that there is 2-hour parking on 12th street that is not controlled by the parking restrictions, and 2-hour parking that is.

I also tend to question whether or not the OP had any experience with DC parking rules. There are 8 Macy's stores that don't require traveling into the city and are easier to access for those from out of town; if the OP lives out of the city it shocks me that he came into DC, and if he lives in DC and drives, he should be intimately familiar with DC parking laws and know that DC is anal-retentive about parking tickets. Every friend I have that drives in DC knows about the rules.

I think if Macy's did direct him to an area where he got a ticket BECAUSE they directed him there, they should make up for it. I just somehow doubt that is the case.

If the Macy's employees acted in the course of their employment and with authority (whether actual or perceived), then Macy's should be vicariously liable for any damages those people have. See also, respondeat superior.

(That's the theory, at least. I'd love to see someone take Macy's to court.)

That's an interesting theory, though I doubt it would play out well. The fact is it is the driver's sole responsibility to ensure they are legally parking their car. I just don't see how Macy's is responsible for a driver's failure to ensure compliance with the law. As another mentioned, had the employee said, \"Hey, you can shoot that guy because it's Black Friday,\" I don't think that would work either.

Further, since Macy's doesn't own 12th Street NW, I'm not sure that a reasonable person would believe they had the authority to authorize parking on 12th St. NW in conflict with the posted law.

Were I to hear a Macy's employee inform a customer that they could shoot me if they wanted--provided the customer didn't act upon that advice, I'd still be seeking criminal and civil charges against Macy's in general and that employee in particular. Ergo, it goes to follow that Macy's should accept some liability for directing customers to park in \"No Parking\" zones.

1) Unless you're a Prosecutor or District Attorney, you don't get to bring criminal charges; even if you did, what's the basis for them?
2) The simple fact you incurred damage (the parking ticket fine) doesn't necessarily mean there was a legal wrong committed. What tort would you base your civil suit on?

There have been cases where someone waves someone on to let them out of a side-street, and the driver of the car pulling out doesn't look to make sure everything is clear, gets creamed, and then sues the driver that waved them on. So while the driver waving them on was just signally that they personally would let the person go, and the other driver pulled out without looking, the good samaritans have been held at least partially responsible. If those cases can be won, I'm sure this case could.

It is a parking ticket. Do you actually expect someone to litigate that? It would cost more for the paralegal to put paper in the printer for this than to simply pay the ticket.

As other posters have mentioned there are important details left out of the account by the OP, but really why can't people accept responsibility for their own actions. \"Because some other idiot told me it was OK\" is not a very good excuse for parking in a no parking zone - or anything else for that matter.

Actually, a surprising number of people do litigate them. They almost never win, as they tend to be people who are crazy and think they know the law better than the city attorneys or the people that hold the administrative hearings that have to happen before the case can be heard in superior court. Once in a while the citizens are successful, but more often than not they simply provide free entertainment. I've never seen someone with a legal background take the tickets to court. They tend to have too little time, adequate money, and more than enough sense to bother.

But, yeah... Nice legal theory posted abobe. lol. It's great seeing law students spewing back the newest theories they've learned in their 1L classes.

Yes, but did you go beyond the administrative procedure, pay $150 to file in court, and then miss several days of work to do so? If so, I hope your satisfaction was worth it. :)

I do dismiss a lot of tickets, probably more than 50% of what I hear. But I see all the cases from our office that gets appealed to superior court, and they are, with one or two exceptions, always ridiculous.

People at the best buy by me wanted the store to pay for parking tickets they got for parking illegally because the lot was full and the cops came in and ticketed people who parked in certain areas because it was cumbersome and if needed a fire vehicle wouldn't be able to enter the parking lot without vehicles moving, I think parking tickets are a sham but in this case its not the store's fault its your vehicle not theirs

If you don't know you're employees are standing out in the street misleading customers, than you're a horrible manager. If you do know, you're even worse. Macy's should take responsibility for the actions of their employees while they were representing the company by paying all of the parking tickets.

If I were in that situation, I would find it plausible that Macy's got a special exception from the city. I would have probably parked illegally, too, because I trusted would have Macy's.

It's Washington, D.C. Everyone should know more than anything that parking enforcement in D.C. is the devil and will viciously ticket and tow all vehicles that are even perceived to be violating any parking rules. I've picked up enough tickets to have learned that the hard way - at least I didn't get booted or towed. It's Friday, a workday, so those rush hour parking signs are still in effect. Sucks that the Macy's employee was standing there and misleading folks, but I would never trust anyone over the ability of parking enforcement folks to screw up your weekend.

I would guess that someone in the staff of Macys assumed (incorrectly) that the Friday after Thanksgiving is considered a holiday. I once got towed from an almost empty \"permit only\" during business hours lot in similar circumstances - everyone except the parking enforcement officer thought it was considered a holiday because most of the staff had the day off. The parking enforcement officer didn't have the day off, so he did his job.

I don't think Macy's even cares - after all, once you park and go inside, you're enslaved to their whims and you're going to try your hardest to leave with whatever you went in there for. So once you get it, you feel relieved, satisfied, and triumphant - and then you go outside and see a ticket. What are you going to do with your new sense of absolute outrage - go return your merchandise to Macy's? Macy's is packed to the brim with people. You'll grab your ticket, leave, and probably won't go back to return your merchandise. But the ticket you'll have to take up with DC police. Macy's won't care - they've already made their sale.

Even if there were a \"No Parking\" sign in the vicinity, ff there was a person who had a Macy's nametag on, I'd park and ask them why it was cool to park there. If I got a story along the lines of \"Macy's negotiated something with the City\" - I'd go with it.

If I didn't get a decent answer, I'd move the car elsewhere.

But that said - if it was a Macy's employee, then you took them at their word - you didn't hire the fool who made the claim that it was OK to park. For all you know, that person has the authority to make the claim. You believed in their \"Implied Authority\" - and it's up to Macy's to make certain that they have Policies in place to control their employees.

Macy's gets to make you whole by paying the ticket. If they don't, then SUE THEM.

Better yet - don't shop at Macy's. They irked me when my wife and I were setting up a wedding registry there and I've never been back since (but that's an entirely different story).

Mmm. Me too, despite my complete familiarity with parking rules in the city I work. I know private contracts are a different matter, but I was \"refamiliarized\" with that the hard way. Turns out you can still get towed for parking at 11:00 p.m. on Saturday night in the parking lot of a store that is open 10:00 - 4:00 on weekdays and closed on weekends. Boy was I mad. Mostly at myself for disregarding the signs, as I figured I wasn't stopping customers from getting to the store. But a year later, I still think it was a crappy thing to do!

I get it, it can be annoying - but if you wanted every single clerk to speak perfect English, you should probably move past Fredericksburg and stay out of the DC area. Following on everyone's comments... it's not Macy's responsibility, and while it's too bad it happened, he has no defense. In addition to my regular job, I hold parking ticket hearings several times a week - basically acting as a judge at administrative hearings. We never dismiss tickets based on \"someone told me it was ok.\" The responsibility always falls on the citizen to pay attention to the posted signs.

I do think that Macy's might, as a gesture of goodwill, want to do something for the OP. The actions of their employee make the store look bad. But it looks like the manager tried, by asking for the employee's name and saying he'd do something. The OP could go back and look for the employee, or give a very detailed description of her if he really can't go back.

At the same time, however, there are SO many people that try to pull scams to get free stuff that I wouldn't be surprised if Macy's decided not to do anything. I spent years working in retail, and saw so many things you wouldn't believe. And I see it now, too, as a lawyer and while holding parking ticket hearings. The dishonest people tend to ruin it for everyone else.

Does anyone else find it implausible that management had no idea that its employees were outside directing traffic? As a general rule, retail employees do the jobs that are delegated to them.

Anyway, I've never been to DC. Is the delineation between private parking and city parking clear? Would there be any reason, for instance, for a customer to believe that Macy's owned the parking? If so, I would say that Macy's should be liable for the parking tickets for implying they had the authority to grant customers parking rights. If it is obvious that the parking belongs to the city, then I think the onus was on the customer to ensure he or she was parking legally. Nevertheless, I think that the best thing for everyone who got the ticket to do would be to return all merchandise purchased on Black Friday and to request a manager while doing so so that they can explain their reason why.

I agree, it's completely ridiculous of this manager to pretend they didn't know who was on street greeting duty or whatever they felt like calling it. She wasn't standing out there for kicks and giggles, I promise.

As for D.C...well, nothing about parking in D.C. is clear. There is little to no delineation of anything, signs are confusing and contradictory, and in at least one area you can end up ticketed by a local university when not parked in their lots but on D.C. streets. THAT'S a fun one.

But being a resident of D.C. they probably would know that Macy's doesn't own the street parking, though I think it's reasonable for them to think that Macy's would know if they were allowed to park there, as parking regulations here are rather fluid and changed frequently for one event or another. Black Friday in the middle of a bad economy? Sounds like a special event to me.

Okay, I'm not going to blame the victim here like everybody else, because I think in this situation the Macy's employee overstepped their bounds, and as such their employer retains some responsibility for that.

HOWEVER, I would like to offer this bit of advice to all readers. I worked in parking enforcement for a while and I can tell you that you should never, ever, under any circumstance trust the word or advice on parking from anybody but the actual parking authority for that specific parking space or structure.

I can't tell you the number of times people said that a person who worked nearby said they could park there, a student, somebody in \"a uniform\" or whatever. We used to joke that if we could just catch \"the guy\" who kept telling people they could park there, we could solve all our problems. These people might not be intentionally or maliciously misleading, but they could be misunderstanding the rules and then you pay the price.

HOWEVER, with that said, on Black Friday when a store employee is posted outside to greet customers, having said store employee not be well versed in the parking regulations or able to properly direct customers is irresponsible on Macy's part, especially considering their location.

This is D.C. This is not the middle of nowhere, this is a city renowned for it's confusing, complicated, and conflicting parking regulations. Any manager worth the title who was placing an employee outside should have known and understood that the #1 question of the day was going to be \"where can I park?\" They should have prepared for that, looked up the rules, and briefed their employees.

THAT is why they hold responsibility, if not for the ticket than for bad customer service. Even though I worked for a private entity, I knew parking regulations for the surrounding streets, and during special events and holidays we were kept aware of the D.C. laws governing the surrounding streets because we would get questions about it. We knew the parking rules for other nearby businesses, etc. Because it's just the right thing to do when you have a business in the city. Parking is horrible here, and if a business wants to increase customer loyalty and satisfaction the first thing they should do is make it easy to understand where and how to park.

I don't understand why the OP would think that Macy's would dock someone's pay to compensate his parking ticket? The money for his \"deal\" will definitely come out of Macy's not the employee. I'm a retail manager and we've never docked anyone's pay for any reason. If someone who works at an office makes a mistake and the business has to cut a deal with the client to keep them as customers, the office worker doesn't get a docked pay, so why would it be any different in this situation? What, did he just assume that the retail industry is extra douche to their employees? They're not, by the way.

.... Customer complains about obscure fault...

the color of the refrigerator in the showroom looks different than the color of the refrigerator in my home. Yes, the SN's match, so it is definitely the same refrigerator. Must be the lighting in your showroom that is different than my home. Can Bob (the sales dude) make an adjustment on the price to make me happy? ....

At which point I will tell the customer I will be happy to dock Bob's pay and make the appropriate adjustment to the customer's invoice because Bob should have been smart enough to know not to sell a refrigerator to a person such as yourself (the customer).


Actually Bob is going to have his pay docked, because any stupid customer complaint such as this one that Bob can't take of himself should be deducted from his farking pay check.

Usually my flippant answer to the customer will get the point across that nobody is going to \"do something\" about the refrigerator's color looking different in the customer's home.


BTW, is docking an employee's pay check legal? Yes. Ethical? Not for a menial wage employee. If the fault is so severe that the business has incurred a major financial hit then the employee should be simply fired. Higher level employees can and should be subject to financial penalties.... ie driving the company car into the neighboring store window because the employee was (videotape proof) talking on the cell phone and drinking a cup of coffee while applying her makeup.... somebody is going to pay the deductable and it aint going to be me.

While I agree that the OP should've followed any signs indicating where to park, I find it hard to believe that two different employees were directing people to park in that area without Macy's knowing and agreeing to it.

As one person already stated, it would be good to know the time this took place, as that would make all the difference in if the employees were wrong or not in their directions.

All I know is that if I were at that Macy's, and saw all those huge \"no parking\" signs everyone's talked about, I'd be a little leery of a Macy's employee telling me to park there. But that's just me!

Yeah...I don't think it's the manager's fault, either. If you don't know where to park in DC and you get a ticket, you're kinda on your own. Parking and traffic in DC sucks.

Happy Holidays Everyone,

As a former customer service executive with Macy's, I find this story puzzling. If a company employee was, in fact, directing customers to park in spaces that were marked \"no parking\" and those customers subsequently received a parking ticket, I believe the company would make good on those parking fines. Did the employee have on a name tag? Can you describe him or her? Did you have a calm, rational discussion with the store manager? You mentioned \"Samuel\" in your story. Did he give you his full name?

Unless something has changed dramatically since I left the company, the store's executive team is mandated by corporate policy to take ownership of customer issues and do whatever is necessary to satisfy the customer. It may not happen instantly, but the customer should get a sense that the person they spoke with is taking the matter seriously and will follow through. We try, as much as possible, to follow the adage \"the customer is always right\".

Here is what you should do:

(1) Call the store during the day on a weekday and ask to be connected to the Executive Office. Tell the person who answers that you have had a very negative experience there and you wish to speak with the store manager to discuss the matter. If the person questions you about the specifics, share the details freely. If the store manager is out and another store executive offers to assist you, let them. Write down the names of everyone you speak with and the dates/times of your conversations. Keep your temper and be civilized. Being hostile will only work against you. If you do not get satisfactory results from this step, proceed to step 2.

(2) Call the store back and ask for the name and telephone number of the company executive who is responsible for the Macy's stores in the district. This location is a former Hecht's store and is part of the DelMarVa-South District of the Mid-Atlantic Region of Macy's East, Inc. There should be a district manager, director or VP. If the store refuses to give you the information, make note of who you spoke with and call the Executive Office at the Pentagon City or Tysons Corner store to ask for the information. Reach out to this district executive with your concern. If this does not produce satisfactory results, move to step 3.

(3) Write a letter to Mark Crosby, President of Macy's East. He is at the 151 W. 34th Street address in New York (in the thread above). Send it via FedEx or certified mail. Be very specific about everyone you have spoken with, providing names, dates, etc. After a week, follow-up with a phone call to his office, if necessary. One of his assistants will handle the issue.

Quite frankly, I will be very surprised if you get beyond step 1. The corporate offices frown upon stores that allow customer issues to escalate to their level. The stores are expected to manage their customer relationships and make amends, when needed.

Try it - I believe you will find intelligent, reasonable people who want to help you. Sometimes the rank and file employees screw up and piss you off, but the leadership really does have a desire to help you. Where most customers go wrong is they make one phone call, blow up and then claim the company does not care. As I said before, you won't get resolution instantly. Macy's is a large complex company. Even as a company executive, it sometimes took me a little time to navigate through the proper channels to get issues resolved.

Well, if you live in DC and are lucky enough to have a car, I'd suggest the Macy's in Pentagon City. Not more than 5 minutes over the bridge from this location, and plenty of parking. I guess I could see going to this one because it has a metro, but again, so does the one in PC. I do feel bad for the folks that listened, probably not being very conscious at 5am.

Yes, I agree wholeheartedly with kingfriday and pecan - The store in Fashion Centre at Pentagon City is nearby (in Arlington, VA), is larger and more modern, and it offers a far better selection of merchandise. I believe the 12th Street store survives off of pedestrian foot traffic. It is not a good shopping destination if you are driving your own vehicle.

The Pentagon City store has always been Macy's - it was one of the \"jewels\" in the original R. H. Macy & Co. before the merger with Federated Department Stores in 1994. Fashion Centre at Pentagon City also has a Nordstrom, which is another great place to shop. Nordstrom sets the gold standard for customer service that other retailers aspire to...

I agree, the Pentagon City Macy's is superior in every way. Not only do you have metro access, just like the one on 12th Street, but if you live in DC, you'd be paying Virginia taxes at Pentagon City. Stop getting ripped off on your 5.7%!
