@ShruggingGalt: When you try to get someone to buy your product over someone else's product, you are, in essence, trying to get them to like you more than the other vendor. You'd think that companies would be able to figure out that pissing off their customers (or even suing them) is not the way to make them more liked.

So why is it so hard for such high-paid marketing geniuses to figure that out?

I like to think im a pretty average person. I on occasion drink energy drinks. If I walk into a store and have to choose between Monster, Red Bull, Rockstar, etc things the company has done to piss off other in the past rarely crosses my mind. I look at the price and past experience with the product. I happen to like monster energy drink, and unless they sue me personally, or somone I actually know, im not going to care.


Sure, I feel bad for the guy getting sued, But I also know that ignoring the message will resolve the problem, since they have 0 legal ground to stand on.

I too, drink energy drinks once in a while, and because of the myriad choices out there, I tend to pick from a few standard brands, Monster being one of them. I can honestly say after seeing what bullies they are about silly (essentially free advertising) uses of the word \"Monster\" and/or a picture of their drink with a \"Monster\" that I won't ever buy their drink again.

Would the settlement work out the same as most typical class actions? Perhaps Hansen can send out vouchers allowing those being sued to pay an additional $3.50 for their Monster Energy Drink as a settlement?

I wonder how the legal counsel for Hansen Beverage Company is finding these alleged \"infringers?\"
On Trygve Lode's blog, the picture is entitled \"monsterenergy.jpg.\" Maybe the legal counsel is just doing automated Google searches to find pages with the words Monster and Energy, and making a list of such pages where they then go and take these pages and just send out a bunch of infringement letters.

Based on the list of Continental's other clients, I am now itching to go post a picture of myself standing in Home Depot, holding a Monster drink and a Black and Decker saw, wearing only my Fruit of the Loom underwears and surrounded by an army of Peeps.

Also, anyone know the legal counsel for Continental Airlines? Surely they would want to know about this other Continental company and maybe sue them for trademark infringement or something. I mean, how many people are confused at first as to why Continental Airlines is suing people on behalf of Monster?

I may have missed an article or something but I see many people implying that they can not use Monster in reference to anything. It seems at least from this article and the one poster earlier today that they are going after people who are referring specifically to their energy drink.

I am not trying to say their actions are justified I am just trying to draw the distinction between saying do not use our product/product name and do not use the word Monster in general.

@ShruggingGalt: I don't know anything about etoys but I forgot about the Vermonster article. However, in response to that I think people pointed out that Monster had registered a mark for the sale of wine or alcoholic beverages.

I definitely hear your point but my point is that Monster Energy is not taking the position that no one can use the word monster on any product they are taking the position that people using or displaying the same or similar products can not use the name, which is common in trademark law.

It's sad because Hansen's has such a great corporate identity, and is generally a good company putting out nominally better for you sugar water.
If it's a situation of their Monster unit going off the reservation, they could do well by yanking the choke collar HARD and bring them to heel. This is getting absurd.

This just in: Monster Cable sues Monster Energy for infringing on it's predatory business practices.

I dropped an email to all 3 companies, Continental, Monster, and Hanson about how the public outcry of what Continental will cause nothing but bad PR and a backlash. WIth the market flooded with energy drinks and drinks in general, this is the last thing a drink maker needs is for one of their falgship brands to get knocked down a few pegs in a very short time. Unfortunatley, most companies have not the understanding of how fast new like this can spread in the internet age and that the public will take action quickly to teach them a lesson. I know we all say we are going to send a letter to the company involved. But seriosuly people, it took me all of 3 minutes to send a copy of the same email to each one. I highly recommend that you all do so. Hell, we still have lots of work to educate everyone about how Monster Cable is crap, as a cable maker and a company. Let's keep the good fight going as The good comsumers we are. We surely can't rely on the government to help us....they have their hands full....with what I have no clue.

RIAA duplicate! If you don't like small business take them to court and break their bank account. This is ridiculous for a company to spend thousands of dollars
on court cost because of a bad review of their product.
I would not drink it ( give me my coffee) and ask others not to drink it due to their lack of customer understanding. Not every one likes certain products and the reasons are their own and their rights as citizens. They should be able to say what they want as long as it is their true belief.

Too bad they have no right to demand he take it down. It is at the discretion of the photographer who took the image. I know my rights as a photographer, and I am allowed to take pictures of anything I want. I can even replicate an advertisement and take a picture of it and do what ever I want with it except claim it to be the original. Sucks for the company to have publicly humiliated themselves over this matter
