Now the company <a href="http://www.state.ia.us/government/ag/latest_news/releases/july_2009/Dish_Network.html">has agreed to pay $5.9 million to 46 states</a> in a settlement announced today&mdash;and at least some of that money is earmarked for DISH customers.</p>

      <![CDATA[<p>According to the press release from the <a href="http://www.state.ia.us/government/ag/latest_news/releases/july_2009/Dish_Network.html">Iowa Office of the Attorney General</a>, customers have had a whole bunch of problems with the behavior of DISH Network over the years:<br />
<blockquote>
<p>The states alleged that DISH Network: Refused to accept responsibility for misconduct by its third-party retailers and installers; violated do-not-call rules; failed to disclose all key terms and conditions of their customer agreements; did not disclose that purchased or leased equipment was previously used and/or refurbished; charged customer credit cards and debited bank accounts without providing adequate notice and obtaining appropriate authorization; and committed other violations. The company denied any wrongdoing.</p>
</blockquote>
<p>If you filed a complaint with DISH Network since January 1st, 2004 that is still at least partially unresolved, or if you file a new complaint over the next 150 days "concerning conduct by DISH over the last two years," then you can participate in the payout. The complaint must be in written form, and sent directly to DISH Network or "through a third party such as an Attorney General's Office, any state Consumer complaint-handling agency or Better Business Bureau."</p>
<p>They'll mail you a letter with an offer, as well as a claim form that you must fill out if you reject the offer. You can then either accept DISH's offer of restitution or other relief, or reject it, at which point DISH must send your complaint to an independent third party Claims Administrator who has to be approved by the state <a class="autolink" title="Click here to read more posts tagged ATTORNEYS GENERAL" title="Click here to read more posts tagged ATTORNEYS GENERAL" href="http://consumerist.com/tag/attorneys-general/">Attorneys General</a>. </p>
<p>You can get all the details of the restitution part of the agreement by <a href="http://www.state.ia.us/government/ag/latest_news/releases/july_2009/DISH_Network_AVC.pdf">downloading it (pdf) and jumping to page 25</a>.</p>
<p>The agreement is called an "Assurance of Voluntary Compliance" and it explicitly spells out what DISH will and will not do moving forward, including how it will handle disclosures of programming limitations, electronic fund transactions, third-party installers, and so on. If you're a DISH customer or plan to be one, you might want to <a href="http://www.state.ia.us/government/ag/latest_news/releases/july_2009/DISH_Network_AVC.pdf">save a copy (pdf)</a> for reference&mdash;it's like your own fine print agreement for how the company must behave in any dealings with you. (In fact, it even says that DISH can't use fine print or "an inaudible broadcast" to hide important details of any agreement with you.)</p>
<p>Sadly, the settlement includes customers in all states <i>except for</i> the following:</p>

<li>California</li>
<li>North Carolina</li>
<li>Illinois</li>
<li>Ohio</li><br />

        <![CDATA[<p>I have been putting off my complaint for some time because I am not a complainer. But recent news reports have changed my mind. $46 million is a lot nation wide for one company such as Dish Network to be ripping hard working people off. My complaint is as most peoples, your given a price, then a few months later it goes up. The bundling price sucks, it's not worth it. Also when your watching something the service will go out, hence no picture. I remember the day when watching tv cost you nothing. Now you pay to see nothing. Sorry for the complaint, but it's been stuck in my gut to long.</p>]]>

        <![CDATA[<p>I wish this went past the 2 previous years. I had one installer install the dish on 4 different places on and around my house. At one point, the owner of the 3rd party installer came over to inspect the work and fired the guy then and there. Unfortunately, the owner, when he arrived was so drunk that someone had to drive him to my house! Then when the switch went bad after less than a year, they said it was covered under warranty, but that there'd be a $100 service charge to come out and replace it.</p>]]>

        <![CDATA[<p>I made the mistake of signing up for a 2 year contract with DISH.  I'm not even a year into it.  I signed up because at the time, they had the best prices.  Well, 3 months into my contract, they raise the prices.  There's a clause in the contract that states they can pretty much raise the prices to anything they want, and I'm still liable to pay.  Garbage.  I need to find something legitimate to complain about so I can get in on some of this money.</p>]]>

        <![CDATA[<p>I remember several years ago when bundling became the big thing, and I was using AT&amp;T for telephone service.  An AT&amp;T customer service rep told me if I paid AT&amp;T $20 that they would send a tech to my house to hook up Dish Network. It sounded too good to be true, so I said, "You mean the $20 covers hookup, equipment, and everything involved in setting the service up?" <br />
  "Yes, everything!" said the AT&amp;T cus. serv. rep over the phone.<br />
 I was suspicious because I knew how much it cost, but I told AT&amp;T to sign me up. A week later when the Dish Network tech arrived, he wanted another $65 on the spot, right then I called AT&amp;T back; turns out the first cus. serv. rep was full of baloney, the $20 I paid was ONLY for the privilege of bundling and none of it applied to Dish Network, so I told the tech to go back where he came from and ask for my $20 back, which was eventually credited back to me. This happened in Oregon. Both companies can go kick rocks.</p>]]>

        <![CDATA[<p>Too bad North Carolina is not part of the states receiving the settlement. I was a Dish Network customer 2 years ago when I got screwed over. When their 3rd party installer messed up my order, they refused to replace the equipment unless I paid for it. This meant my "free" satellite dish turned into a $150 charge to get international channels when it was supposed to be included with my original order. On top of that, they continued to call me after I cancelled and asked to be removed from their calling list. At least they are getting their due with this and the TiVo case.</p>]]>
