<p>According to TMZ, the lawsuit alleges that the giveaway was a "scam to deceive its customers into spending more dough."</p>
<p>From TMZ:</p>
<blockquote><p>The suit says this "bait and switch" caused customers to incur "travel costs, paper and printing costs, postage, the money they spent on other food items at KFC on visits when they had intended to redeem the Coupon ... and the loss of the value of the promised Meal."</p></blockquote>

        <![CDATA[<p>That's totally bogus. It was a FREE meal that was given out. If you got there to long waiting lines, you had a choice to LEAVE and spend your money elsewhere, or not eat at all.</p>
<p>Nobody forced you to stay, to leave, or to cough up money to buy extra crispy instead.</p>
<p>I got to KFC to a long 25 minute wait. It was our day off, and we had nothing else to do, so why the hell not. The staff was friendly, frustrated, and the entire crowd blamed Oprah and everyone had a laugh and were understanding.</p>
<p>When the chicken was finally done and started getting passed out, a resounding "yay" was heard. I think <b>normal</b> people were understanding. Anyone else is a freakin' jerk to think that they are privileged to receive FREE chicken, and then to bitch and moan and ask for MONEY when the restaurants were overwhelmed for, what was it now, SIXTEEN DAYS STRAIGHT, if I recall right? May 1st through the 16th or something like that? <b>For free food?!</b></p>

        <![CDATA[<p>The level of idiocy it took to put out a coupon like that in the manner they did is surpassed only in the idiocy it took to refuse to honor the offer. It's not about a lousy piece of fatty, greasy chicken. It's about the fact that KFC did not deliver what they offered. They put out an offer, then changed it after the fact. You can't do that, plain and simple. </p>]]>

        <![CDATA[<p>Frankly, a promotion that large (nationwide) with Oprah behind it should have been thought out better. I printed the allotted four coupons and gave two to the wife.</p>
<p>She went and redeemed the coupon. She got her free meal. 1 of 4 coupons redeemed. I should be more upset. But I am not. She said the chicken was disgusting-- dry on the outside and tough on the inside. Though, the sides-- as always were great.</p>]]>

        <![CDATA[<p>This was nothing more than a marketing &amp; publicity stunt by KFC.  They had full knowledge their stores would be overwhelmed, and even had a canned Youtube video prepared for when they stopped accepting the coupons.  The biggest giveaway to the intentional nature of this sceme was the excessively long 2 week redemption period coupled with the fact that a PDF coupon was made available, which could be used indefinately for 2 weeks.  Since copied coupons were not acceptable, doing this nullified their obligation to honor any coupons at all. <br />
We are now living in an age in which corporate fraud is an accepted business model, as long as you're indirect.</p>]]>

I've heard of other companies running similar kinds of promotions lately, and most of them have run out long before the end of the day. I know someone who works at a car dealership where they give away free hot dogs once every summer. He said usually people only have to wait a minute or two, and this year, people were waiting in line for up to an hour. Seriously? An hour for one hot dog? There's just no way to anticipate that kind of turnout. While I agree KFC probably should have planned better, the fact of the matter is, they were giving away something for free. Some stores ran out and others had really long waits, but are either of those situations actually a surprise? I received an email highlighting this promotion and immediately deleted it knowing my local KFC would be a complete shit-show. I don't have sympathy for those who are so riled up about the fact that they didn't receive something for free. KFC is trying to rectify the situation, albeit slowly. Next time, just go into a situation like this anticipating black Friday crowds.</p>]]>

        <![CDATA[<p>I wouldn't say they should be sued for those reasons, but KFC completely dropped the ball on this promotion. I went there, waited in line for about 15 minutes, finally got to the counter, and was told that it'd be another 15 minutes before they had any more chicken. I said "screw it" and went to Sonic instead.</p>
<p>I mean, how stupid of a company do you have to be to not realize that "free food" + "recession" = "crazy-high demand"? Each location should have had far more grilled chicken ready for people to try, and on the off chance that a location actually did run out, they should have had a sign up saying what the approximate wait time for a new batch would have been.</p>]]>

<p>It is real chicken though, ever so technically. But they can't take a breast from a barrel and then decide to either batter or grill it - they take a battered, frozen breast from a bag in a freezer and bake it. (The frozen batter thoughtfully includes all the grease you need.) The grilled chicken is microwaved and heatlamped.</p>

        <![CDATA[<p>The only "lack of planning" was their refusal to reimburse franchisees for the cost of the chicken they gave out. I'm astonished that they actually did such a thing ... it seems unconscionable to me that the KFC imposed a cost on their own franchisees, who are -- at least theoretically -- their business partners. But they did it anyway.</p>
<p>That said, any lawsuit here should be between the franchises and corporate over this imposed cost and lost sales that resulted. Customer suits seem a bit frivolous.</p>]]>

        <![CDATA[<p>I think the real "Bait and Switch" was the beef flat slathered all over the chicken.  Since it is not currently legal to inject poultry with antibiotics and hormones, people will eat chicken who can't or won't eat beef (especially the fat, which stores all the excess toxins, hormones and medicines).  THAT's what somebody should sue them over.</p>]]>

        <![CDATA[<p>I went to the KFC in Allen Park, MI on the final day of the promotion only to find the manager telling its customers that there was an "error" in the bar code of the coupons and therefore all were useless.  The mail-in handout she gave me for the replacement coupon required a postmark date during that same day, which fortunately I did mail in time.  I have yet to receive the replacement coupon.</p>]]>

        <![CDATA[<p>@<a href="#c13708793" rel="nofollow">pwillow1</a>: Yes, the law isn't perfect, and the lawyers that dedicate themselves to these sorts of cases can do quite well *when* they win. But I'll bet they eat it when they lose, and getting a case to the point where a big Corporation decides to settle has gotta be a bit of work. There's not 1:1 compensation for the customer that got screwed or the citizens that got the Superfund site.</p>
<p>HOWEVER - without these "ambulance chasers" taking on these cases, your kids would be eating more lead in their toys, you'd still be choking through the secondhand smoke of teenagers while you try enjoying your meal, and your electronics and other purchases would be nowhere near as safe and reliable.</p>
<p>Take away the lawyer "sharks" that serve as a disincentive to Corporations screwing customers and running wild against the general public, and you can bet the Corporate-owned politicians won't save you. Trial lawyers are a necessary protector of our democracy, regardless if you don't end up with your "free chicken meal" in the end.</p>]]>

<p>More like another example of corporate fraud. They're a big, grown up company. They manage to get their franchises all over the world including within dictatorial regime countries.</p>
<p>And yet they accidentally-on-purpose printed a bunch of newspaper coupons and also promoted this through viral marketing on the web and were "shocked" that people would actually clip the coupon and bring it in? Gimme a friggin' break!</p>
<p>KFC has clearly done a "bait and switch" by setting up this promotion as they did. Hope a jury looks at store-by-store increases in sales during the promotion and decides that KFC benefited by this fraud.</p>]]>

They allowed me to buy grilled chicken, but told me I needed to send my Internet coupon to KFC to receive another coupon--a rain check. I haven't received the coupon and I'm not really expecting it. So for those who believe KFC didn't honor coupons because the restaurant ran out of chicken--not. KFC was protecting its finances by trying not to give away too many  free meals too fast or by not giving away any at all.</p>]]>

<p>Why are you so sure they don't realize that?</p>
<p>I saw an interview with their CEO or Prez, the guy with the Australian accent, and when he was asked about the bad publicity from all the problems they had with the promotion, he *completely* blew it off because, "Now there's not a person in America who doesn't know that KFC has grilled chicken."</p>
<p>Press for the promotion, press for the snafu, it's all very valuable attention. And it sounds like the hoops they made people jump through to get what they were promised are a large enough detriment that a lot won't even bother.</p>
<p>I'm sick of phony lawsuits as much as the next person, but I'd love to see some discovery in this case showing that KFC knew this was going to happen, and they just went ahead with it anyway because they felt the attention would be worth screwing everybody.</p>]]>

You get to promote the offer and you get to limit the damage.  Dell does it for a lot of their coupons.  They will have limits of like 3k redemptions and such.</p>
<p>If you are going to let everyone in america print out, you need to honor it.  Hell after stores were already denying the coupons you could still print the coupon.</p>]]>

The form wanted all your contact info, you had to mail it in with a stamp(what like 45 cents now?), and they were going to mail you a new coupon.  Instead of just honoring the one in your hand.  It was definitely a scam.  Contact info is worth money and they were demanding it just to replace the coupon in your hand with the same thing.</p>
<p>This is about issuing coupons and honoring them.  I fail to see how anyone could be opposed to it.</p>]]>

        <![CDATA[<p>I ordinarily would not support such a thing but in this case I think it's fully justified.  Not only was the KFC management totally irresponsible in thinking they could force franchised stores to provide unreimbursed food, but they also probably didn't count on the fact that some of the franchisees that wouldn't offer the food would also refuse to accept a voucher request (KFC in Whitehall, Michigan, I'm giving you the stink eye) because it was "too late in the day" (5:30 PM) on the last day of the promotion. So I support this particular lawsuit, just because of the massive stupidity shown by the KFC corporation in how they handled this.</p>]]>

But this lawsuit serves the larger good.  I am SO sick and tired of idiot-ahole consultants running these promotion gimmicks at these companies and wasting consumer's time, just as much as the potential of wasting their money.  People shouldn't have to call individual stores before they go and say "do you have any chicken left?" when they are PROMOTING it.  HELLO!</p>
<p>Technically, consumers who spent time and money and energy driving to stores for the sucker-punch promotion should be compensated gas money too, therefore, lawsuit warranted.  Not that they'll get that out of the lawsuit. That's a whole nother topic.</p>
<p>KFC, Do your damn job, plan the promotion right and make sure you are ready before wasting everyone's time with "Sorry, we are a chicken business and we are out of chicken, have a nice day".  Retardiculous, and they deserve to be a laughing stock and ridiculed for it.</p>
<p>Stop doing things Colonel Sanders would be ashamed of and want to beat you with his cane for, or stop showing his picture everywhere.</p>
<p>Oprah should sue them too for any damage to her reputation out of it.</p>]]>

        <![CDATA[<p>I actually got three free meals (out of the four entitled) by going back three different days. On the fourth day, they said they ran out of chicken, and issued the rain check coupon. But I was very surprised by the quality and the fact they let me choose white meat.</p>
<p>I admit that I was a glutton, and don't expect the free coupon to be mailed. But overall, I was really happy by the promo after I got the coupons to print (which was a nightmare, especially on my Mac).</p>
<p>I'm sorry for all those that didn't get hot, juicy, fresh chicken and sides. Our NYC 14th Street store has been consistently good.</p>]]>

<p>I went down with my coupon and was turned away.  They I had to go back and get a form.  Then fill out the form and wait for a new coupon.  So what should have been "go down for my free meal" turned into "make 3 separate trips to KFC to only get free food on the third trip".</p>
<p>I'm sure lots and lots of people made purchases there when they were expecting to be able to use their coupon.  Seems like there was still plenty of fried chicken, so why wasn't that chicken grilled instead?  Hmmmmmmm.</p>
<p>In the end, it became too much work and I never got my free chicken.</p>]]>

        <![CDATA[<p>There is a local Dairy Queen that does half price day and they get slammed like you wouldn't believe with people buying 2 or 3 days worth of food however they are extremely prepared and probably the most prepared they can possibly be given the size of their store.  Even though its only half price food believe me people treat it likes its free food.  They hire extra employees for the day and they never run out of food.  I have never seen them run out of anything during this sale.  They make the cakes and ice cream during the day so they can constantly refill the freezer.  The manager is on hand and smiles and personally hands off the food to each customer purchasing. I really want to give props to my local dairy queen for doing this right.</p>
<p>This is an example of how a promotion can go very well and be done right.</p>]]>

<p>A company that doesn't know that people will actually want free stuff is... a very moronic company (and probably not a company that I want to do business with).  Someone up in marketing doesn't know what they are doing.</p>
<p>Of course this is only fast food so its very trivial in the general scheme of things.  I personally don't even eat fast food unless its a very big emergency that I have not planned for.  If it was a company that myself or my company that I work for was doing big business with and they did a promotion similar to this and were completely unprepared, I might reconsider where I take my business.</p>]]>

        <![CDATA[<p>I also had no trouble getting my KFC the first day. They even let us (hubby and I) choose light or dark meat and what sides we wanted. We've gotten grilled chicken a few times since then because we liked it when we got it free. I think that KFC needs to fix the problems that caused the issues in the first place. ie Deal with their own people. Honestly, when you give away free food anytime, even without people having money issues, it's probably going to end up in disaster. I'm just glad I didn't have any problems.</p>]]>

        <![CDATA[<p>Bait and Switch laws are in place for a reason.  If KFC knew, or should should have known, that the majority of people trying to use coupons would end up having to buy something else, then the lawsuit is a good thing.</p>
<p>It's not about somebody not getting free chicken, it's about a Corporations lack of regard for the law and advertising anything they dam well please.  The whole franchises not honoring parent corporations advertisements is getting out of hand and does need to get reigned in.</p>
<p>This is probably an appropriate suit at an appropriate time.  Might help the overall franchises business.</p>]]>

        <![CDATA[<p>These lawsuits always seem to be promoted by lawyers; they will represent one or two plaintiffs, and then they'll try to get more plaintiffs to join the class action suit.  What happens then is the attorneys representing the "class" of litigants will negotiate a deal with the defendants (KFC) whereby all the plaintiffs in the class get some stupid settlement like a coupon for $5 off their next KFC meal, but the lawyers who represented them in the class action suit get the defendants to agree to a settlement to pay them MILLIONS in legal fees.</p>
<p>Over the years, I have received dozens of notifications asking me to join one or another class action lawsuit, usually for products I have purchased years before, and I have always refused because I don't want to unjustly enrich lawyers in this form of legal extortion.</p>]]>

        <![CDATA[<p>Not worth a lawsuit in the least, but I really, really wish companies would realize what they're letting themselves in for when they give away things for free. How many times have we seen variations on the themes of "Company server overwhelmed by coupon downloads" and "Company locations swamped with customers/running out of free product"? And the company always issues a statement to the effect of "Gee, we didn't know people would actually want free stuff!"</p>
<p>IT'S FREE STUFF. OF COURSE PEOPLE WILL WANT IT. I mean, if they <i>don't</i> want it, you should really start worrying, because obviously your product is horrible.</p>
<p>If you're going to have a giveaway, here's what you need:</p>
<p>1) Backup servers for your backup servers<br />
2) A supply of the free thing that's at least ten times what you think you need<br />
3) All the employees you can fit into your stores</p>
<p>And you're still going to get slammed, but at least you'll be halfway prepared, unlike all these flaming morons.</p>]]>

        <![CDATA[<p><p>I tried the grilled chicked a few days after it came out and I was not impressed. It was dry and didn't taste like good ole grilled chicken. The word fried is in their name for a reason folks.</p><br />
<p>But what really annoyed me was I had a hankering for some original recipe chicken that afternoon and had to wait in a very long line of people who were seriously pissed when they were told they could not use their coupons to get the dried out grilled chicken. The whole thing was a bad idea and probably did not create new customers but rather brought out the worst in people looking for a free meal.</p></p>]]>

        <![CDATA[<p>I had absolutely no trouble getting my free chicken. The fact that KFC was on the way to my destination the day I redeemed the coupon meant I did not incur any extra travel costs.</p>
<p>The cost of printing the coupon was marginal and not worth getting upset about.</p>
<p>I was also pleased as I was able to get a breast since they ran out of thighs when I got there.</p>
<p>The only thing that I was upset over was the fact that the grilled chicken was underwhelming.</p>]]>
