I never understood Gamestop's pricing scheme for used games. I've also come across games with different price tags on them, even right next to one another. As I'm standing there, I usually realize that 1) the used game is a mere $3-5 less than the new game, 2) the new game is still above the industry standard price for the game, and 3) Newegg has ridiculously good prices on games.

@supercereal: and 4) GameStop does not sell new games. All games they illegally sell as 'new' are opened by store employees, discs stored behind the counter and an empty case displayed on shelf. The games are then free to be played with and even taken home by store employees as a sort of 'free rental' benefit.

they DO sell some wrapped games, you just have to ask or say you won't buy. Its worked about a half dozen times that Ive set foot in their horrid stores because ultimately, when a shop has what you need that no other place does, you will go to that shop. I hate the store and all that it represents in screwing their customers but their used game prices on OLDER games (ps2/xbox/gamecube) just cannot be beat. I picked up god of war II for $9 used and I had a look at the disc and it was flawless. The one thing I do love doing is saying no to all of their crap when I buy like 5-6 used games and they want me to insure each one for like 2-5$ a pop (depending on what system). They alway load me up with the \"are you sure?\" then I start a mini argument with them to explain to me the reasoning of why I would need to insure a game disc that I don't intend to use as a frisbee and since if the game is defective, I can bring it back for an exchange anyways. Boy do they hate me at my local store... I know it seems like Im a douche but Im just throwing back what they throw at me.

@supercereal: Video game prices drop FAST, especially on sports games and movie tie in games that only sell right after the movie is launched. When someone trades in a 60$ game and only gets 25 or 30 back in store credit GS is factoring in depreciation on that specific title. That 59.99 copy of movie game x may drop to 39.99 within 2-3 weeks of the movie's launch. If no one buys that game that the customer traded in GS is taking a loss if they give 45$ trade in for it. Since GS takes accepts nearly all games for trade in they will take losses on some titles, because there are titles that sit on the shelves for months and even years before someone decides to buy them. When you buy new games at launch you are paying a premium to have it the first day. There are games that hold their value longer but the market is cluttered with tons more games that don't live up to their hype so they drop in price fast.

I just bought a copy of a game at GS, it was down to 12.99 used plus I used a coupon to get it cheaper. When I pulled back the stickers that game was originally priced at 34.99 used, which means its been sitting on the shelves for a long time and depreciating in value because no one wanted to buy it.

Try to run a video game store with high trade in values for a while, chances are you won't be in business for too long. If you want full value or close to it for your games sell on ebay or craigslist, GS is just an option and they are profitable because they know what they are doing.

They may even have price drop lists from the manufacturer ahead of time for all I know..

While GS does a lot of evil things, I have to defend them on their used pricing scheme because its just impossible to make money on something that depreciates quickly if you give high trade in values for games. It doesn't matter what kind of business you are. Also the customer has a choice, no one is forcing customers to trade their games into GS.

When I worked for a video store these price differences occasionally happened because of our protocol for pricing used DVDs. We went to our distributor's website and searched for the film title and charged OUR approximate cost for a new DVD (for example, if Steel Magnolias cost us $6.47 to buy brand new, we would charge $7 for a used copy).

Sometimes our distributor prices would change, so if we got the same title a month later, the price might be different (the SKUs for our used inventory were generic and only reflected price, so there was no \"quick\" way to check what price current inventory of said movie was). We would go out on the floor occasionally and search for this discrepancy, but we occasionally would miss a few (and obviously charge the lower price).

Many of Gamestop's used prices are $5 less than new ($59.99 vs $54.99), if you question this employees will often tell you that \"well, it would be $10 off if you had our discount card\"

I've never full understood why such a ginormous markup is needed (if you are taking the game in for $30, you can sell it at $45 and still make a health profit) but the company is making money so they must know what they are doing.

I've seen this too, where I'd be at gamestop and see two of the exact same boxes for a used game with two different prices. Of course, I grab the cheaper of the two.

Just a thought, in some cases the price of a used game does go up...but I doubt that was the case here if both price tags are exposed (typically they'd stick the newest price tag over the older one).

Back when N64 games were being made, a local Gamestop would sell the games that didn't have a box or booklet for just $5. I got Smash Bros, the Zelda games, everything (over time) for just $5 each! So since then they implemented this flat price per game thing.

According to my local Gamestop, when they have a sale/promotion on an item, they don't just mark it down at the register, they put a sticker with the lower price on it. At my local Gamestop they also suck at removing the sale stickers. My brother in law was about to jump on a Wii Guitar Hero guitar set that was marked for like 59.99 before we saw a second of the same thing priced at 89.99. In other words, Gamestop needs to go back to Training 101 and teach their employees how to remove sale stickers before putting on new ones (or forgetting to put on new ones altogether).

In terms of retail in general, if there's 2 stickers on something, I would always assume it's going to cost the higher of the two unless the cash register says differently. If the second sticker is on there, that's the justification to have rung it up as such, fair or not.

I know several of my employees fail at price changes (fail to check the spine, or find other copies that may be in a promo shelf, or what not), and I've had to mark it down.

You should forward that to the FTC and see what they say.

That must be a poorly run Gamestop. The last one I worked at, My manager and everyone who worked MOD there was excellent about honoring the lowered price AS REQUIRED BY LAW.

We once had to eat a $30 loss on a game that had a 29.99 sticker on it when it should have been marked at 59.99.

There's only one reason Gamestop might have not done it in this case: The two stickers on the case were for different games: For example a game case for FEAR, showing a Fear xb360 price sticker at 19.99 while the other sticker shows Mass Effect xb360 14.99. Obviously FEAR is not Mass Effect and I do know some Gamestops are either reluctant or flat out refuse to honor a price discrepancy like this.

Having said that, there's absolutely no reason the Gamestop in question should have been so stupid about not giving you the $5. That \"not being able to credit\" is BS. They can void out the sale and re-ring it through at the lower price or even refund the first purchase and ring through another.

Something like that happened to me before, where there were two stickers on the game box, and I didn't look very closely as to what the stickers said. One was like 14.99 and the other was 19.99, so I figured I was getting $5 off on this sale. Took it to the register and the girl that works there noticed it and pointed it out, then removed the $14.99 sticker. I was like huh? what's happening? but she said she would go down the middle on it (i.e. give me $2.50 off) because it was a confusing mistake on their part. That particular store is very on the up and up and have always had my back on any issue too. Very professional at that location.

That occasionally happened to us (I was at a store in Manhattan, 2005-2006), and sometimes they'd come in with different price stickers than we already had on one that was in the store (so let's say, Tuesday night I took a trade-in and the resale value of Game A was $19.99, then Wednesday morning a box came in from corporate with a copy of Game A priced at $17.99).

Definitely no reason the store can't do the adjustment / credit, though.

The statutes explain the adjustment must be made at the register at the time of purchase.

I don't get the triviality of fighting over a $5 pricing error because even if the retailer saves the loss they lose a customer. On the other hand if they honor the lower price they gain a customer's loyalty, and their establishment will most likely be the first stop when making future purchases.

The saddest thing is Gamestop probably go the game for $5 in trade (maybe even towards a used game), so in the end their margins are essentially unaffected.

I imagine that the clerk is going by the price that rings up on the computer. Seriously, how easy is it to peel the lower priced sticker off of another product and stick it on the higher priced one?

I'm not saying that this person did it - or that it wasn't a mistake on Gamestop's part - but it shouldn't be an automatic jumping down Gamestop's throat for this policy.

@dave_coder: The problem with that is that the stickers have a UPC code on them specific to that game. You can't just replace a sticker from one game with a sticker from another and expect go get away with it.

By the way, I've noticed more than once that GS will raise the prices of used games and place stickers over or around the older stickers, resulting in issues like this one. That they raise used game prices from time to time isn't a problem. However, if the OP's issue is due to the often irresponsible placement of the price-tags by a GS employee, then yeah, they should most definitely be taken to task for it.

They gotta figure out a different way to do it that doesn't leave your game with about a million tags on it, and that doesn't lead to problems like this if done haphazardly.

I had the same thing happen to me at game crazy. Crackdown for the Xbox 360 was marked at $9.99 and under that and little to the side was $12.99. I took it up the cashier who said that the $9.99 was a sale price that ended and that he couldn't give me the $9.99 price, even though it was clearly marked as such.

It was a great game that was still incredibly cheap, but it stuck with me and annoyed me to no end.

The legality of this depends entirely on state law. It may be illegal, but it may not be. Like was suggested by Chris, the best thing to do is simply contact the state AG and file a complaint. If they determine it's illegal, they may take action if they deem it appropriate.

Granted $5 is not a big deal and they should have done something for you. It appears you paid by card and chose to hit yes to pay $21.39 instead of $16.04. Pay attention! When a card terminal asks \"is $21.39 ok?\" You push no and tell the clerk about the other price.

used to work at gamestop - to matt and anyone else who has or may run into this type of situation. the associate(s) who sold the game to matt and would not honor the price were wrong, even by gamestop standards. if matt calls the dm or left a message and gets a call back, i'm sure that the wrong employee and his manager will receive a corrective action, or if is not the first similar offense, will be terminated. really want to get them mad - take it up the regional or divisional level. this all has to do with their LP, inventory marketing PRICE CHANGE system and the way it is implemented and managed. it also has to do with poor training, or at least execution of training in dealing with these situations after it leaves the HR office. there is a handbook as all corporate companies have, but don't expect that anyone besides the store manager and maybe the assistant has even glanced at it. and dont get me started on used/gutted sold as new?? thats a whole different topic

in any event they were wrong, you were right matt (of course) after all this aggravation i'd ask for a full refund in store credit towards a reservation to make them happy AND the ability to keep the game - take it past district level and you might see changes in the gamestops in your area within the next year

Here's how to solve this quickly and easily:

1) Do sales tags have expiration tags on them? If the lower price was no expired then you should get the lower price.
2) Do the tags have dates on them? If yes then it's reasonable to go by the newer tag. If the newer tag is the more expensive tag then you should pay the higher price.

IMO, the cashier did the best thing she could have.
He left the store happy with the price he paid.
There's no way to determine if the sticker was there when he bought it, or if he himself slapped it on after walking outside of the store and beyond the view of it's all-seeing cameras.

@Coop: Except that the reality of the way Gamestop runs its business drains the sense out of your hypothesis.

1. The customer would have had to have seen the game at the lower price, and assumed that it would be going back up eventually. This is unlikely, given that they use yellow price tags to denote used games as a standard, and there would be nothing on the price tag to suggest that the game's used price would climb back up somewhere down the line. Besides, if the guy had reason to believe that this may happen, why wouldn't he have bought the game then and there instead of employing inane measures in order to try and scam Gamestop?

2. Let's say that something did give him reason to assume that the price would go back up, and that for one reason or another he didn't just buy the game then and there, but had enough of an interest in the game to hatch an elaborate scheme to bilk Gamestop out of five bucks somewhere down the line. He'd still have had to remove the price-tag in full view of the employees. Given that most of us can't get the damned things off in the comfort of our own homes without dragging out a hair dryer or steaming the damned things off with a pot of boiling water, it's unlikely that he would have been capable of removing the price tag in its entirety, much less do it without the employees noticing that he was doing it. You can't produce these tags at home either, just in case you considering going there. You'd need the bar-code that is uniquely keyed to not only the title in question, but also the price it's being sold at, and that's not information that he'd be able to get just by doing a Google search. .

3. I would imagine that a scammer who went to these lengths to get a mere five dollars off of a used game would probably have put the sticker on BEFORE buying the game. Besides, I've known my share of scammers, and none of them have ever made it a point to push matters when their scams don't work. The risk of exposure is too great, and that five dollar scam can end up landing you in a heap of trouble for committing fraud.

So no, he didn't put a sticker on the game after the fact. A Gamestop employee failed to properly cover the old price with the new price tag. It happens all the time around here. Generally they're pretty good about adjusting the price to the lower price though, and their failure to do so in this case was the crux of the issue.

@H3ion: It probably depends on the state you live in. I am almost positive its illegal in NY state to sell a customer an item for a higher price than what the tag states. I've seen this policy posted in many stores. Conversely an employee cannot change the price in the register if the item comes up at a lower price than what it is supposed to be (this mostly happens when employees forget to change the tag). It would be rare but you never know when an employee is going to try to override for a higher price then pocket the difference and I assume the law is in place to prevent that from happening. NYS is pretty strict on pricing laws.

I think there is a state that requires a 10% discount on top of any pricing errors too.

I worked at GameStop and this happened more frequently than you might think. Every morning the opening manager is supposed to do the day's price changes. Say the price was dropped to 14.99 one day, then (usually a week later or so), the price changes come in and it's raised back up to 19.99. The manager will reprice the product. It prints out 1 sticker for every copy you have in inventory. The problem is they will change the face sticker but not the spine sticker. I always just removed the cheaper spine sticker altogether and just kept the updated face sticker. If the manager fails to do that then there will be 2 different prices on the item. It can be a problem. And the reason that they didn't want to do anything about it is that the store gets in trouble if it has to manually adjust a price. Word to the wise: GameStop *is* able to manually adjust prices, but they *will* tell you they cannot. They'll say they don't have that ability but they're lying. They can just get in trouble with their higher-ups if they have to do that because it means that they didn't do their job and update the prices like they were supposed to.

You should check to see if the bar code on the back is for a different game. It's possible one of the game stoppers slapped the wrong bar code sticker on the back.

I worked at an EB games once and we always honored the lower price when accidents happen. I'm surprised they didn't help you out.

The response from Kris Bennett (manager of the Gamestop in question) is standard corporate rhetoric. I know that employee training is expensive and time consuming. I also believe that many companies cut costs by under training their employees and then let the customers correct the mistakes of the under trained employees. The customer is basically a guinea pig for the employee to practice on while he or she finishes learning their job. I resent having to do quality control for businesses like that and would rather do business with a more responsible company. Employees need to be closely supervised until they are proficient enough to act on their own. Companies that don’t understand or ignore proper training procedures risk driving away their customers. For instance, because of the responses to Matt’s problem, I now know that Newegg sells video games.

Gamestop treats it's customers pretty well. My fiancee has worked at one for 3 years now. This looks like a case of a stupid employee. This company has really good customer service. However they treat their grunts like shit. There is a reason my fiancee wears a \"Game-Gestapo\" shirt during her off hours.

There shouldn't have been a need to talk to a manager to get a refund. I have never had a problem returning a used game to Gamespot within a week of buying it. Their official policy is to allow returns for up to a week. An employee told me I could use it like a free rental if I really wanted to.

I went to a Gamestop to trade in some games and get money towards another purchase. I was told that I wasn't going to get any money for 4 out of 9 games because they were \"worthless\". I figured they were right. They were pretty lame games anyways.

Well, after he told me the amount I was getting I browsed the store to find my next purchase. When I returned to the counter I noticed that the dude had taken my \"worthless\" games and placed \"Used $9.99\" stickers on all of them. I said, \"What are you doing?\" The look of confusion on this kid was priceless! He just didn't understand why I wasn't giving him the games regardless of their value. Well I'm sorry but I would rather give them to my friend who has small kids for free then have them profit from them. Is that wrong?

pah, I had this exact same problem with a big-name video rental place (BB) but with 4 games that they wouldn't honor the price tags of - the manager even canceled the transaction and started removing the price tags in front of me saying \"this isn't correct, this isn't correct, this is wrong and this is wrong\" it rang up a $40 difference so I said \"no thanks\" and took it up with the Regional Manager who was very helpful and cleared it up: if it's got a price tag, that's the price we'll honor. He gave me a nice credit on my account to compensate.

For some reason, the Consumerist didn't run MY story. I'm growing sour grapes. :-(

I've never had a problem with EB/Gamestop except for the fact they open new games. In a way, I understand it given the fraud that goes on, but then there is nothing that keeps them from defrauding me, plus when I give a game as a gift, it makes it look like it's already been played.
