        <![CDATA[<p>I never got spam texts until recently. When I called to get Sprint to make them stop, the friendly CSR volunteered that cell phone companies recently started to sell their number to telemarketers, which of course is when the texts started. So far Sprint has been cool about removing the charges, but every time it's 20 minutes on the phone. Maybe the law should do something about cell phone companies giving up your number without permission.</p>]]>

        <![CDATA[<p>You can block telephone numbers with Verizon. You can either call customer service or send a message to customer service (from MyVerizon) with the subject "Nuisance Call Blocking".</p>
<p>Up to 15 numbers can be on the list at one time and the block lasts for 3 months. It blocks both texts and calls from that number.</p>]]>

They will pay some police union somewhere a fee for the right to use their name and then go on a telemarketing rampage pretending to be the police. One such scam is the "California Organization of Police and Sheriffs" (COPS get it?). Man are those fuckers persistent, too.</p>

Since most of the spam we get comes from countries that don't have laws against spam, there is nothing the US can do to stop them.</p>
<p>What we need is an international committee that has the authorization to cut a country off the internet if they don't want to comply.</p>]]>

The whole concept is ass-backwards; someone can send you a text with a fake subject, and if you open it, you're billed for a subscription.  It's completely wrong.  And of course, AT&amp;T will only "reverse the charge with the vendor on your behalf", meaning they want you to pay your bill, with the invalid charges, then wait for a credit next month.  What a scam!</p>]]>

Do you think there would be any 1A issues if someone stole your printing press so they could print up some political flyers?  What if they stole your computer so they could post their opinions on a blog?</p>
<p>The spam issue is about taking (and very much in the depriving the owner of use) computer/network resources.  To avoid the 1A issues, the law needs to focus on the theft aspect and not touch on the content of messages at all.  Simply borrow from the same categorization of senders that the DNC list law uses, and apply it to email.  But instead of actually having a list, define a specific way to let domain name owners indicate their preference to opt out, such as "no spam" in the SMTP connection response.</p>
<p>Suppose a used car dealer lives across the street from you.  He puts a sign up on his lawn that says he has some cars for sale at deep discount prices.  That's one thing.  But now suppose he puts the sign on YOUR lawn, facing at your front window?  Do you see a 1A issue with you charging him with a crime?</p>]]>

If you put everyone whom has any business texting you into your whitelist problem solved. But the closest thing Verizon will give you is the ability to block up to 4 domain names from sending you text. You can't block phone numbers from texting you and 4 is not enough.</p>]]>

If you go into your online account, you can change your texting preferences to not recieve emails or web texts (but you can still get them from other cell phones). You can also call them and have them block premium text messaging (the ones that end up on your bill as a monthly subscription). I never get spam on my phone anymore!</p></p>]]>

<p>Oh, that's right...it made no difference.  Shock and horror, it turns out that the people who send out junk email don't actually care if it's illegal or not.  One more waste of time and money in Washington.</p><br />

        <![CDATA[<p>"Yes You Can Spam Law" is correct.  That law was written to preempt more restrictive state laws that were threatening to actually reduce spam.  This will end up the same way ... functionally defining "permitted spam" for text messages.  This will include all the usual crap about having a "business relationship" that means virtually anyone who has ever heard of you (and all their "affiliates") can legally spam you with text messages.  Politicians will, of course, also be exempted.  I'll bet that some large corporation or political party is being stopped from sending text message spam somewhere, so they need a federal law to explicitly make what they want to do legal.</p>]]>

        <![CDATA[<p><p>We have too many laws on the books now that either aren't (or can't be) enforced.</p><br />
<p>Even controled environments (like the Yahoo Finance message boards) get hundreds or perhaps thousands of serial spam messages per day.</p><br />
<p>We are on the "do not call list" and the "auto warranty" and "lower your credit card interest" people continue to call.</p><br />
<p>We have one email address that gets 5 or 6 spam messages per day from the same spammer. I report all to road runner. They stop a few but the messages keep morphing and getting through.</p><br />
<p>So the issue, it seems to me, is one of intent. If we really want to stop spam, then we must send spammers to jail and that raises all kinds of first ammendment issues.</p><br />
<p>I would love to have an anti-spam law; but I don't want one with no teeth.</p></p>]]>
