Pepsi Sues Coke For False Advertising, Demands Recall Of Sports Drink

-->Pepsi is suing Coke over claims that their new sports drink, Powerade Ion4, is "more complete" than their own Gatorade.

"There is no evidence, scientific or otherwise, that Powerade Ion functions better than Gatorade as a sports drink," the lawsuit said. "There is no evidence that Powerade Ion will help consumers achieve better hydration, have more energy or get nutrients that will result in improved athletic performance."

The complaint claims there is no evidence the "minute quantities of magnesium and calcium" present in the Powerade drink make it superior to Gatorade.

The lawsuit actually demands that the drinks be recalled if their labels contain the false advertising message.

"Defendants' entire advertising campaign for Powerade Ion4 is a calculated, intentional strategy designed to falsely and viciously attack the readily- identifiable market leader, Gatorade, in the hopes of unfairly gaining precious market share," the lawsuit said.

Coke's spokesperson said that they couldn't comment because they'd not received the lawsuit.

They never said that it "functions better". They said it it was "more complete". Hell, they could have said that it "boosts the immune system" or "encourages wellness" for all the difference it makes.

Learn from the FTC: companies that make medically meaningless claims about their products don't generally have legal consequences.

As we see there are plenty of people in the comments who hate gateraide and poweraide but swear by their particular choices for sports drinks - even though none of them are better than a regular diet and water.

@The_IT_Crone: I think that's the ticket right there. If I have propel or some other flavored water around the house, I usually stay far more hydrated than if I just have water. I know this because when I only have water in the house, my pee is yellow, but if there's Propel or gatorade or whatnot, it's usually a lot clearer. If you gave me 20 ounces of gatorade, I'd probably drink just about all of it, but if you gave me 20 ounces of filtered water, I'd probably drink significantly less.

Plus I don't really like very cold drinks, when I buy soda (rarely) I drink it at room temperature unless it's really warm out. Room temperature water tastes like shit.

We used the powdered kind, and the coach would make it super weak, half strength or lower. It made the practices go better, and it would stave off hunger somewhat--you can't eat (or eat much, at least) before you're going to be swimming hard, and Powerade had calories, which, if you're swimming for 3+ hours, is a good thing. If you're running on the treadmill to lose weight, not so much.

Believe it or not, Gatorade still has its place among athletes. When your sweating, you need more than water to hydrate effectively. Gatorade contains valuable electrolytes (fancy name for sodium) and carbs. to keep you on track.

And I challenge anyone to carry milk in their pack while running for any amount of time.

Accelerade is ok if you can get past the taste. And there were studies showing that a 4:1 carb to protein ratio was more effective in energy recovery.

Heck, some legendary runners even use flat Coke during their runs.

@moore850: Gatorade derives its name from some professional sports team in florida called the "Gators" (football, I believe) where the formula was originally developed. It did provide measurable benefits under intense circumstances where players were depleted from practicing in the intense climate they have there. it was also the first sports drink on the market by a good decade or so.

The thing about Gatorade is that it is completely trivial to replicate, and the only thing it has is brand awareness and market share. There was an interview with a gatorade beverage chemist talking about gatorade. The Interviewer asked if the formula for gatorade was secret or proprietary and thus more effective, and his answer was "not really. anyone can take gatorade to a lab and determine whats in it. I guess it really pays to be first."

I don't see how Pepsico can win this one because there's a lot of brands out there that have said they are better than the other. It's all just trying to get the consumer's attention. Pepsico seems to be having a bad year so far with their horrible redesign for Pepsi and Tropicana (which the consumers won the Tropicana one); doesn't mean they need to bring Coca-Cola down with it. Whether the Ion4 is any better, I don't know; it's not the end of the world if isn't.

You guys are really uninformed.

Gatorade/Powerade/any sugary drink is bad for you if all you do is sit on your ass in front of a computer.

Infact, something that is high glycemic such as gatorade/powerade/etc is something that you'd want as you work out.

Why? To spare your glycogen (stored energy) and glucose (energy ready to use).

Again, why? Consuming steady amounts of carbohydrates in small amounts (i will usually do 4 fl oz every 15 minutes) will spare your muscle mass and keep your body from metabolizing it. Don't believe me? Get the proper test strips and see how much ammonia is in your piss after you work out.

The only thing I agree with is whoever said that chocolate milk is the optimal post-workout "meal". You'll have an ideal mix of fast digesting carbs (again, to spare muscle catabolism), whey (fast digesting protein) and casein (slow digesting protein). I've seen this times and times again and it'll be way cheaper than any protein you can buy. Don't worry about HFCS in this case.

I used to drink propel... until they added fiber to it. Thanks for succumbing to the whole fiber craze. Why would you want to slow carb digesting when you're working out???

Actually, if you test my water, it DOES contain sodium/potassium. Especially my softened water. Still, it doesn't contain enough to make up for excessive sweating.

Your last sentence also has something people should realize, that most people who suck down these 'sports drinks' should realize - if you're working out for less than a couple hours, water is better for you. That hour at the gym? No sports drinks needed, water would be better for you. I'd estimate that 99% of these drinks are consumed when plain old water(flavored, if you want), would be better.

These drinks were originally designed for serious athletes playing LONG games, often in hot, humid conditions - such as footballers, soccer players, etc...

Your average person working out isn't putting enough strain to exhaust their store of glucose or electrolytes.

The question is whether Coke is just doing "puffery" or if it goes beyond that. I think it's questionable, but lean more towards "puffery." You are allowed say stuff like "My product is more awesome then their product." You just cannot make concrete claims about superiority that are not based on anything. Calling something "more complete" is pretty vague, so I don't think it falls into the category of making a concrete claim that needs to be supported by evidence.

Agreed here that Gatorade and Powerade generally aren't good for you. Chugging them during your 30-minute huff fest on the treadmill isn't going to do squat.

There are far superior electrolyte drink mixes on the market which can benefit the every day pursuit of physical fitness. (My personal fave is Hammer HEED)

At most, taking some Gatorade with water while you're doing a long strenuous activity - 5K or longer - is about the only time you should drink these. Even then there are better options out there, like Accelerade.

(That or when you're hungover).

Gatorade is best used for rec league soccer for the kids.

My favorite "energy" drink for working out is 100% grape juice with some vanilla flavored protein powder mixed in. The sugar helps speed up absorption of protein and the protein helps slow down absorption of sugar. So your sugar derived energy lasts longer while the protein helps your muscle from turning catabolic. Either that or I just like the way it tastes like a grape creamsicle...:)
