@AnonymousFinger: It doesn't say on the settlement website you have to be a former customer, just that you had to have the account during those dates. The language they used is weird, though. I still have my account there but I just put 12/31/07 as the end date.

@jblake1: nope... they got me just last month. (yeah, it was my own fault... I have keep the change savings rollovers, forgot about that, and it went into my overdraft protection which charges a $10 fee... which put me into an actual overdraft. a $5 latte bought two hours before my paycheck direct deposited cost me $105 thanks to high to low processing.
I closed my B of A account for a reason... Now I get money too? SWEET!
This is a travesty. Bank of America has been pulling this sort of shady shit for at least 8-10 years. Paying $78 (maximum) to the few people that hear about the settlement and bother to file is a joke.
When you have a bank that EVERY SINGLE POLICY is designed to rip off its customers (even its bank managers admit this!) the greedy attorneys representing the class action need to, for once, stop worrying about their ripoff fees and TAKE THE CASE TO TRIAL so that the real truth comes out, lots of negative publicity happens, and enough people are outraged to insist that their elected officials take aggressive action.
I'd personally like to see multimillion dollar fines, personal liability by senior bank officials, and perhaps jail time.

But you should know, the lawyer's job is to above all else, do what's best for the client. Class actions are messy and dont all end with Erin Brochavich (spelling) endings.
If you want multi-million dollar fines then RTFA, BoA will pay $35,000,000.

Griffin, yes, this is legitimate. I personally verified all of the case and settlement information. In addition, I confirmed that the domain is valid and owned by one of the top Settlement Administrators (Rust Consulting.) They do a LOT of settlements so don't worry about them being a scam.
I submitted my checking account number in the claim form myself. I'm not sweating it. If you want to worry about something, keep an eye on the Heartland case. Now THAT will be an interesting settlement once the case gets filed (within the next month or so.) It just keeps getting bigger and bigger. Hopefully we'll see a CASH settlement and not just free credit monitoring. My guess is it will settle within the next 1.5 years.
Anyone else want to take a guess as to when the case will settle when it hasn't even been filed yet? ;)

I used to work for bank that shall remain anonymous and you would be surprised with how many people would come in having no clue what their available balance is. The problem is most people get \"swipe happy\" and never log their purchases. Then there are also banks that take forever to make that info available online (tisk tisk WaMu). The best way is to save your receipts, and have some sort of logging/ tracking sheet (think check register) and you can avoid paying the banks anything. If you know that on 1-20 you had $1000 and on 1-21 your mortgage came through for $995, Don't go and get your $6.95 coffee on 1-21 as well. Then again you can only lead a horse to water.

I remember having a discussion with BoA customer service asking why they charge big purchases first, then little purchases, even if that's not the order you charged them in. It seemed designed to cost you multiple overdraft fees. They said it's because they want to satisfy the merchants who have been promised more money first, then the mercahnts who you have less of a financial promise to.
@Griffin Hammond: The option to give your address (at least online) is way too small to let you type in your address. Also, if you try typing in something else in the account number box (like \"Same as above\"), you get an \"Invalid Account Number\" warning.
I didnt see any security on that site, so i'm not chancing it. It gives you the alternative to enter an address so I just entered my street address.

You can give your address (at the time you held the account) in you don't want to give your account number.
I've been with B of A since 1997, and still have my primary checking and savings with them.
At one point in May 2003 I was $280 overdrawn due to overdraft fees simply because B of A approved transactions I had made during a routine shopping trip in Austin, Texas on a Saturday morning.
Coffee, a few office supplies at various stores, and a 12 oz. Diet Coke...and a few small grocery purchases later in the day.
I called to check my available balance - I spoke with a rep to be sure everything that was supposed to be taken from my account actually had been deducted from the available balance, and she confirmed they had.
Lo and behold on Monday, my account was in serious overdraft.
I called B of A, described what I had done and to whom I spoke with, and was told matter of factly by the new rep that a large purchase had gone through, sending all additional purchases into overdraft.
I informed her that \"large purchase (rent!)\" had actually posted to my account three days before.
She said it in fact it had, but B of A reversed the charges that morning (midnight Sunday/Monday actually)due not \"receiving the proper paperwork\" from my rental company.
She refused to define \"the proper paperwork\".
And the 12 oz. Diet Coke?
It cost me $36.19.
@TheBitterFoodie: Always remember that any purchases made after 5PM on Friday, Saturday, Sunday and Monday won't post until Monday night. So you can always deposit first thing in the morning on Monday and those purchases would be covered. (This may not apply to all banks but I know BofA, Wells, and WaMu do process their debits and credits this way.) These banks process credits before debits by law.

That's why I keep a minimum balance of $1000 in my BoA account. It's not that hard to do if you are a disciplined spender. It got real easy to do once I paid off all my credit cards. You'd be surprised at how much extra money you have when you don't have any CC payments.

I just closed my account because of overdraft fees. The smug asshole bank rep at the branch had the nerve to tell me that even though its wrong and not logical to post from high to low they can still do it and i am SOL. Fuck you Bank of America.
I opened a CD with them a few years ago. They told me if I opened a checking account with them I would get an extra 0.5% interest, and all I needed was to put $1.00 in it to open it up, so I did. A month later I'm being charged $18 a month because I had under a certain amount with them (I believe $10,000). Needless to say that whatever interest I was getting from the CD was DWARFED by the fees I was paying for the checking account.
The day after I got my statement I went and closed both CD and checking. I told them why and they looked like they could care less, as this is probably a regular thing they have to deal with.

Hell yeah! I went through this crap with them more than once in the olden days of dirty Bank of America trips.
Wachovia used to do this to me all the time, I swear. I'm a college student, and honestly wasn't that fiscally responsible. But I don't think that's the only explanation for why fees like 5 dollar trips to the restaurant would be assessed multiple weeks after the purchase, and after big purchases had drained all my money.

When I first heard about the asshattery of BoA I asked my Credit union about how they handled transactions, and they go by the time stamp of the transaction and don't re-sort any of them. So my payroll direct deposit comes in at 12:00AM every Friday and doesn't get put behind any withdrawls to put me in overdraft.

$78 doesn't even put a DENT in some of these customers' losses. If I were in their position, I would be one of the first to line up and send a letter of objection to the court if I had incurred one red cent above $78 from their predatory practices. Shame of Bank of America.
I had a similar experience with Citizens Bank in NYS. They \"Graciously\" removed 1/2 of the overdraft fees, but we still were out $120 due to their rearranging of charges.
We soon joined our credit union, and we've never been happier.

You shouldn't have to cushion your checking account but you do-- most people who have the cash to do so have several hundred extra dollars tied to checking they would otherwise have earning interest somewhere precisely because the banks are so dishonest.
And we wonder why we have a savings crisis in this country? Not one bank should get a dime of bailout money.

Yup, US Tank did the same to me. They held 5 or so small transactions for a week and once a large purchase came through they ran all these smaller transactions through and charged me a $30 fee for every transaction. I talked to the bank manager and he said they have no control over when transaction go through and wouldn't give me any break on the fees. You can't tell me places like McDonalds aren't processing credit transactions daily, it would make no sense for them to wait a week to push a $5 purchase through.
So I ran my account several hundred dollars negative, now they can spend several hundred trying to get that money back from me. I don't care about credit score anymore, I'm going cash only.
Darn. It works for current customers, but since I use my credit card for everything to accrue awards and avoid such a thing, I haven't had such a fee, so no settlement for me.

Wells Fargo is currently being sued for the same thing. I've been with them for 9 years. Two years ago, I got screwed royally on a business trip to Mexico. My company delayed my expense check so I had to use my own money. Then someone was suppose to deposit the check in my account while I was still there, but didn't happen. Once everything was said and done, I paid $800 in overdrafts and neither my company or Wells Fargo would help me. Regardless of what settlement they come to with WF, I'm considering opting out of the class action suit. I'm sure it will be along the same lines as BofA's.

B of A put the last nail in my coffin of respect when they started giving checking accounts to illegals.
If you can submit a claim it's your duty to object to it and demand that bank of America fix the overdraft issues and pay back all the overdraft money they collected. It makes no sense to just give everyone 78 dollars when they can validate exactly how much in overdraft fees each person was charged. Bank of America should return all overdraft fees + fair damages and be forced to only charge a standard credit card rate for overdrafts in the future.
Wait they did what? I thought all banks could and did do this. Desert schools was like this to me, they had higher $ charges in first and let me overdraft my account to +1,200$. I never paid them back, mainly because they never asked. I never closed the account.
When I had overdrafed from my business trip, my final balance when i realized what happened was -$2000. For 9 full days my account was overdrawn and WF kept approving my transactions. When I asked why they didn't decline any of them or give me a courtesy call, the CSR couldn't give me any good reason.

I still don't understand why people are complaining about the way Bank of America posts it's transactions. I mean the policy is written in black and white in the agreement that we all sign when we get the account; I know i have seen and read it! So if this is a surprise to anyone then that just proves that you arent doing your homework and being responsible for your finances and that means that I have no sympathy for you. I have banked with then for years and have never had a problem.
When I first had the account I did overdraft my account and payed the fees, but guess what I learned from it and never over drew my account again. I think that many of the people who bitch and complain about this are those that don't care to take the time and learn about there accounts. In fact I know that is the case since I use to work for the bank a few years ago (I was a customer service rep which is the bottom of the totem pole so im not getting paid for these comments) and it was the same type of people calling about fees; the people who don't check there accounts and they spend more then they have.
Which brings me to my next point. Accounts would not become over drawn if people didn't spend more then they have. I don't overdraw my account because I spend within my limits. there is no excuse to spend more money then you have. Learn to budget. No one else is going to do it for you we are all adults and we should know how to do these symbol things.
I always get a kick out these types of responses. It's not like we aren't willing to take responsibility and pay an overdraft fee when it's our doing. It's the practice of reordering transactions so that not just one transaction \"bounces,\" but multiple. Come on, this is why there was a class action suit.
I've seen many similar responses on the net from people like you. Most I suspect work for the bank. But some are those who can not relate to, or understand the circumstances some of us are in. Regardless, Bank of America steals from its customers. Just because they haven't stolen from you, doesn't make it right.
If you have a credit card with a set limit, do you think the issuer is going to allow you to go over that limit? The same can be done with debit cards, which is why I now use PayPal for everything possible. There is no such thing as a NSF fee. If it's not there, the card won't work.
My only hope is that someday you miss the fine print in some contract, or fail to keep up to date on their latest modifications of terms and fees, and you get burned. The way corporations operate, and the failure in government oversight, I suspect it will happen.

Okay people...I've heard y'all say that a number of big banks do this. But where would I go to avoid these practices?
I recently paid $140 in overdraft fees for purchases totaling about $14. Is there anything I can do? These purchases were made during January 2009.
@laurahatesu: I got BoA to refund 1/2 of my overdraft fees on three occasions for these shady practices. I physically went up to the bank with my screaming 2 year old and told them that I demanded that they refund the fees. It took some arguing on my part but I eventually got what I wanted.
I've tried to get the fees refunded on the phone and NOTHING ever happens. They kept transfering me around and kept me on hold for HOURS and I never got through.
Going up to the bank and making a stink was the only recourse I've found.

Coincidentally I had a problem with BoA and Overdraft Fees TODAY.
My Online Banking said I was in the clear for money, so I made 5 purchases, each under $10. Then apparently my account was NOT okay even though my online banking said it was and a check hadn't gone through yet so they charge me $25 for each transaction ($125). So after the fees, NOW my account is overdrafted for real and they will be charging me more because their fees created MORE fees.
I'm not too pleased but I called in and they corrected the first fees of $125 but I'm probably going to have to call again tomorrow to removes the ones that will show up tomorrow.
Anyhow, I want to take part in this lawsuit (not necessarily for the money) but I don't feel comfortable putting my banking number into the online form, is that safe?
When I lived pay check to paycheck I would have to basically cut expenses like crazy every time i payed rent in order to avoid the \"reordering of transactions\" that contributed to so many of these overdraft fees. It sucked cause not only did I occasionally have to lose money when I just couldn't keep enough in my account, but I actually had to skip meals and do other shitty things in order to try and keep enough money in the account to avoid this crap. I'm still with BofA just because other banks I've been with in the past were shittier and I no longer live paycheck to paycheck.

One reason why people acquire so much in overdraft fees (and why BoA sucks so bad) is because they have different \"times\" that transactions hit your account. (I learned this the hard way on several occasions. It took a very candid conversation with a rep to learn all of this.)
Debit card transactions can \"pend\" at the time of the purchase. But, they may not \"clear\" your account for several days (even weeks).
Checks written on your account do not \"clear\" until 11:59 p.m. However, BoA \"clears\" your checks BEFORE they \"clear\" your debit transactions if the debit transactions are less than the checks. Because you can't tell what checks are going to \"clear,\" unlike with \"pending\" charges, there is little way to avoid accidentally going overdrawn as you sometimes can with debit transactions.

Hopefully they'll all be easy to claim like this one, and cash claims. Yes, $78 isn't enough. Most people (including me) have spent WAY more than that on these fees. I finally got my act together and started balancing my checkbook instead of depending on the bank to update their records. It's a pain, but necessary.

I know that most people come here to either A. learn or B. complain, with that being said, when you opened your accounts I am almost 100% sure that you got the fee schedule and account agreement. This tells you EXACTLY what the bank will charge you for. The real problem here is being held accountable. If you are going to trust a company to handle your finances inform yourself on how they will handle your purchases, deposits, what fees are involved, etc, etc...By reading and understanding what you are getting into should pretty much mean that you know how to avoid any and all bank fees. If there is anything that troubles you keep asking until they ease your worries. Most banks want to build a lifelong relationship. This means they want you to come back for credit cards, lines of credit, auto loans, home mortgages, HELOCS, and investments if they offer them. Banks are highly regulated so they must adhere to standards set by the government or they will lose their charter. The customer also must bear responsibility with how they handle their account. When the dr gives you a prescription and you choose to take one too many pills is it still the drs fault or is it yours for not following directions? The same logic can be applied to bank and credit accounts.
I always like to know the rules of the game before I play it.
When are the people of this country going to take responsibility for their own actions, If you don't have money in the bank, don't write the check or use the debit card, It's simple math people, if you cant add or subtract do not open A checking account.

LOL. just last night I was on the phone w/ a bofa rep. Monday I called to flag a company that was on auto withdrawl. I had to cancel because I never knew when or how uch they were going to charge. I was informed by the agent on monday that there was another pending charge that had put my account over by $10. I said that was an unauthorized charge and was told that it couldn't be disputed until it had cleared.I immediately deposited $300 cash to cover anything else in my account . My balance printed at that time was $298 (this account is maily used by my son for daily expenses, so that was more than enough). I called the next day to again dispute, but was told the transaction still was pending so couldnt do anything. When I checked my account online last night, it shows on the 26th, my account was +$88. The 27th +388 BUT, after the deposit, I was assessed FOUR $35 overdraft items, which in turn caused 6 other charges (from 12-5 dollars) to be overdraft all over an item I had been trying to dispute. When Itried to get a straight answer as to why I was being charged for a item I had been trying to dispute, the rep became obnoxious telling me I didn't understand...Of course I didn't understand! It didn't make sense!. He kept telling me all the data I had (ie online account info and printed balance receipt) were incorrect. The fees were incurred on the 26th, but weren't processed until the 27. I told him that if these items had been overdrawn on the 26th I should have been charged that day for them, not a day later. He insisted I was wrong and \"he could show me\" how that was feasible. I got pissy and told him no he couldn't because he just told me that all info available was incorrect. How can they do this time and time again. I AM NOT signing off on the $78. I am looking into filing on my own against them...or at least dreaming of how fun that would be
I had a rental car hold on my debit card. BofA charged overdraft fees even though my account NEVER reached a negative balance. The explanation given to me was, It would have been a negative balance if the rental car company put the deposit hold through. BofA is as bad as congress. They all need to go to prison.

They don't care about you and they have no problem telling you that.
Recently I had the same problem with BofA.One day I checked my available balance through phone and online before going to the atm to withdraw money.It said I had a balance of $50. I withdrew $20 for gas and made a purchase for coffee that was under two dollars and bought a gallon of milk. A few days before I had purchased pizza. This charge was out of pending mode. The next day, I had an overdraft charge of $140 for my purchases for the day before. The bank said it was my fault. I should have checked my balance before hand. Now if your system is telling me what my available balance is, who fault is it for wrong numbers? Come to find out, the pizza place didn't deposit their receipts for purchases on that day. This transaction didn't happen the day I withdrew money, it happened five days before hand! So a $1.75 charged ended up being a $35 charge for coffee. A gallon of milk for $2.99 plus $35, withdrawal of $20 plus $35, also the charge for the pizza $27 plus $35 all because I made those purchases the day before! Total it all up, it comes to almost $200 for no reason. All my fault according to those dim-witted tellers who only care about making sure the bank gets as much money as possible.
Another time a company withdrew money from my acct. under my fiance's name. His name is even on my acct.! I was charged an overdraft fee for this mistake. My fiance doesn't even use my acct. for anything. Then the bank said there was nothing they can do even though I did not authorize any debits nor did my fiance even if his name is not on the acct. How can a company retrieve money from an account that isn't somebody's and I still get the charge for it? Once again more ridiculous charges. They even put this crap on your credit repor if you try and close to dispute the chrages. Beware because no other bank will accept you if you have a bank charge on your credit report!
You being charged a monthly fee? If you use your bank card at least once a month no fee, its stated on the online banking page, box on left. I confronted the bank manager and it was never seen again. What about giving me the money back they took the rest of the time?
I am not willing to settle now they have been screwing me for months so this month I used my card and listened to make sure they were taking the money out and I knew my mortgage payment would come out on monday the fifth and sunday I took out enough for it to bounce well some how all of my transactions changed dates and bounced everything causing me to have many overdraft fees now I need a lawer
