force banks to loan to risky individuals, and anyone who tells you otherwise is a liar trying to make the foreclosure mess a race issue.</p><p>The law that everyone claims was passed to force banks to make risky loans never forced a bank to do anything but make they use the SAME criteria they use on \"unfavorable\" loanees as they do \"favorable.\" Namely just because you where a minority or currently lived in a unfavorable area could not be held against you as a deciding factor.</p><p>Prior to the law banks could discriminate based on race who they gave loans to, regardless of your ability to pay.</p><p>This did not open the door to risky lending, that was done completely on the own by the banks because risky lending = more profits as people with less money pay more money in The Coulters and Bill O's of the world have convinced everyone that it was loaning to minorities that caused this. That has zero to do with it. It was the fact that money was so cheap (i.e. Fed interest rates) that banks could afford risky loans even if a few failed. Baaa! Baaa ! Some sheep actually believe this nonsense. Make no mistake, this crisis is a made on Wall Street affair and any other explanationis just horseshit. A new \"cramdown\" law will force lenders to really try to make modifications to bad loan products for the same reason that companies settle lawsuits on the courthouse steps: They have no control over the process when it gets to court.Better to take a haircut now and have a small,manageable loss than take your chances with a judge that may want to crucify you for an abusive product.</p><p>BTW- This whole episode shows that the big megabanks like Citi have the \"me first\" mentality to cut a deal that they think serves their own narrow interests. Local banks,credit unions and thrifts dont want this because a LOT of them wrote every loan like they would keep it on their books. It's just that a lot of people turned out to be poor credit risks when given the opportunity to get more of it. What do I care if home prices go down? Oh, no, I go underwater and can't move! THAT WAS A RISK IN BUYING A HOME, PERIOD. If you don't accept risks, don't take them.</p><p>Social safety net? Again, these people are going to be going onto that even without a bail-out.</p><p>If the banks thought stuff like this was a great way to help them make money, or at least lose less of it, they'd be doing it. live in it?<br />OR<br />2) does the owner walk away &amp; the lender takes repossession of the collateral?</p><p>in cases where the debtor is \"upside-down\" in their home, a bankruptcy attorney will often recommend that they walk away. this benefits no one b/c:<br />1) the debtor loses their home.<br />2) the lender must take possession of the property &amp; liquidate it (which in this market could mean a significant loss if FMV - fair market value - is considerably lower than the loan balance).<br />3) the lender cannot recover any money lost once bankruptcy is discharged.</p><p>with a cramdown, both the debtor &amp; the lender benefit b/c:<br />1) the debtor gets to stay in their home.<br />2) the lender continues to receive payments on the balance of the loan up to the value of the house.<br />3) the lender can petition the court for payments from the reorganization plan for the \"unsecured\" portion (the balance above the home's value) for 3-5 years.<br />4) if the debtor fails to complete the reorganization plan to the satisfaction of the court, the lender can go after the debtor for any money lost (including the balance above the home's FMV).</p><p>it is in no way a bailout. it's a release valve for both borrowers &amp; The result of foreclosure is that you go rent. Renting sucks, but we did it for years before buying a home. If we lost our place, we'd go rent again. All of these poor criminals aren't going to be getting loans to buy these foreclosed houses anyways.</p><p>I most certainly do not believe that some random investor should be _forced_ to bear the hit so that you can stay in your home. If the owner of the mortgage and you want to work something out, feel free, that's great - but forcing them to do it is a direct invasion of their property rights, and you need to have a damn good reason for doing so. Why? Because they lose money in foreclosure sales. _Massive_ amounts of money. Do you really think the houses from the story yesterday in Detroit originally sold for $500? No, but that's what they're selling for now. The lenders that foreclosed on those homes are taking hits for tens or even hundreds of thousands. If my mortgage lender foreclosed on me tomorrow, they'd sell this place for $30K tops, leaving themselves upside down by $100K. Is that a better deal for them than rewriting the terms of the loan so they only get a guaranteed $115K? Not so much, I don't think. I'm quite curious to know where you believe the \"criminal activity\" comes in, however. Debtor's prisons went out of fashion quite a long time ago. All this law does is modify the terms of bankruptcy law (which is already exceptionally punitive) to allow for some homeowners to have a greater chance of keeping their homes and some lenders to have a greater chance of maximizing their returns.</p><p>(As for renting - only until the rental market is saturated, which will happen rapidly as foreclosures go up and aging housing stocks that weren't renewed with the push to home ownership go out of commission. They will probably get a major credit score hit which will follow them for 10 years (the reporting time when you declare bankruptcy). So, all their future loans (car, credit cards, etc. ) they will be paying a much higher rate. If the bank could break even or make money selling the house, they'll just foreclose and call it a wash.</p><p>The cramdown will extract more money from the deadbeats who are upside-down on their mortgages, thereby relieving pressure against other mortgages, because the bank has more money. Let me ask some of the experienced lenders that let them borrow the money in the first place, did you think they could afford the house? If not then why was the money lent to them? And what are you going to do about it. The last thing is shame on the People that are knocking the ones that are already hurting. How do you know they could not afford the house when they bought it? Just because they are in foreclosure?  Wrong! maybe they lost their job that paid the mortgage or someone was injured and not able to pay. I am so Sick of hearing people being ridiculed for something that may be of their control. Can our Government have a heart and bail out the people that are NOT Big Corporation, or Millionaires on Wall Street. But it's not as if they forced it on the borrowers, either.</p><p>Your \"well, what if they lost their job or had medical problems\" argument is bogus. Foreclosures were spiking WAY before the massive lay-offs we saw in Q4 of last year. You'd have to be in willful denial to not admit that adjustable-rate mortgages resetting is what caused all of this, at least initially.</p><p>I don't think anyone, individual or corporate, should get bail-outs. Does that make you feel better? It will be controversial and it's not without problems, but I see no other solution. Too many people bought homes at wildly inflated prices and now owe mortgages in excess of what their property is worth. Their liabilities are greater than their assets. Government has got to get this leverage out of the economy and the only way to do that is to cramdown the debt principal of mortgages.<p>But it can't be limited to bankruptcies, because that will create an obvious unfairness that will be the subject of class lawsuits; it could even be a taking. We're going to need cramdowns as policy, with big groups of mortgages lowered. Investors and mortgage originators will hate it, and government will have to help out, but there's really no other way. We'll never get out from under the recession until we reduce the number of people who owe more than the value of their property. The market needs to correct itself and return to prices of 2000, maybe even late 1990's given the current economy. And yes we do get screwed by footing the bill. And so what if they get a credit ding, they get to keep the house (which is main reason for credit score). This is ridiculous, government meddling is a big part of this problem, I don't trust them to fix anything. A lot of home values have dropped ridiculously, but people are still locked into their old value on their mortgages.  They're paying for something they aren't getting.</p><p>A truly fair market would be to ignore all this and let them flop, but the next best thing is to step in and give people their money's worth. Government meddling did cause this mess, but it was because the government took away many of the red tape involved that would have basically prevented the banks from investing in bad loans.</p><p>The banks wanted profit, there is absolutely no profit in you or Bill there having a good job and able to pay your mortgage on time or even paying more than the allotment. Your a BAD investment just like people with credit cards who pay them off in full and on time.</p><p>Banks dont want good people who manage money, they want schmucks who miss bills because it means MORE money for them. They want to prey on the lower class, and minorities, and elderly. People who have strict incomes who can tend to miss things like rate changes and the like.</p><p>The only way to fix this now is to put all that red tape back. The market will still reign it's self in even if this is done, because ultimately the banks know they fucked up royally. But dont think for a second they wont try this again in 10 years.</p><p>The problem you and a lot of people have is you dont understand our form of capitalism. We are not a true capitalistic society just like we are not a true democracy. Everyone was saying mortgage rates would go up as lending got tighter (which made sense). So I got a 6% rate on my loan, which was like 1% better than I had at the time. Now mortgage rates are at 5%! However, there is one key problem.  Since Bush passed the recent Bankruptcy Act, it is much more difficult to file for bankruptcy than ever before.  Perhaps the lovely politicians should think about amending the bankruptcy act temporarily to make it easier for citizens to actually file and complete the leg work before paying off the debt.</p><p>I am no expert on cramdowns, but I would imagine that a bankruptcy court judge would do a cramdown anytime they wanted to.  Of course there would probably be objections by the lenders but that doesn't mean he can't do it.  It has been a while since I have clerked in a bankruptcy firm so I don't remember all the specific rules of what a bankruptcy judge can and can not do.</p><p>All in all, the bankruptcy act that Bush passed is unconstitutional IMHO.  It should be demolished.  I don't know if the Obama team will get around to this or not though considering they already have a full plate. In fact, before the BK act, cramdowns were used as an incentive to file a CH13 instead of a CH7. They were considered \"abusive\" however and removed with the act. month. When we asked why, they said because the economy was bad.</p><p>For 30 years we have always paid our bills on time if not early.
