@Coles_Law: Actually, my first reaction was that they should counter-sue to cover their losses to date, but then I realized that after pursuing this case for so long, the idiot's probably broke. So, all they would accomplish by a counter-suit is to drag it out further and earn themselves more lawyer fees, even if they won.

I am of the opinion that frivilous lawsuits such as these should have a very serious backlash to the filer. If it is proven to be a huge waste of time for all involved, the judgement should be against the plaintiff and the plaintiff should be required to pay attorney's fees for all parties involved. That would stop this kind of crap from happening, or at least taking as long as this has. I feel for the Chungs, this sucks and it is destroying their business. What a complete ftard (thanks Adisharr, haven't used that term in a while...appreciate the reminder it exists!).

I realize this is going to sound bad, but maybe we should hang him by the seat of his pants...
I was reading the Examiner this morning on my way to work and there was an article about this. I didn't know this originally, but as you may or may not know, part of his lawsuit pertains to the dry cleaner guaranteeing same day service. I didn't know this but Fancy Pants dropped his clothing off FIVE MINUTES before they closed and expected same day service. And that is part of the reason why he sued.
Regarding the satisfaction gaurantee, Fancy Pants also said, and I quote, the dry cleaner must pay the customer \"whatever the customer claims the item is worth if there is a 'Satisfaction Guaranteed' sign in the store, even if the dry cleaner knows the customer is mistaken or lying.\" That's his argument as to why he feels that he should be given 54 million dollars.
The article also mentioned that Fancy Pants always fights to the end. He even took some of his previously worthless cases to the Supreme Court. I'm sure we have not yet seen the last of him, unfortunately.
@SabreDC: And this is why we need to amend the law of the land so that if, in the opinion of the judge, the lawsuit is frivolous, the person bringing the lawsuit owes the other party three times the legal fees they paid.
They do something like that over in England, and they suffer through far fewer of these silly cases than we do here.

But what was the context he was saying it in? And who was he? They were villians planning a murderous plot. So of course they didn't like lawyers or the law, lawyers would interfere with their illegal activities.
Now, if you type in \"kill all the lawyers\" into google, the first result is some douchebag's blog claiming that the correct interpretation of the line in its context is incorrect. I couldn't figure out how Seth Finkelstein was able to make his result number 1, especially since it is king of poorly reasoned. But then I saw that what he is \"a software developer and Internet activist\" which I suppose makes it more likely that he can get his b.s. blog to the top of the google results than that he would understand what he's talking about.

I think there is one thing clear. Fancy pants is a vindictive, small, petty man without a soul. From everything I've read this guy set out to harrass and destroy this family and their business. For that, he should be forced to pay. I think they can make a pretty clear case for this and should countersue this nitwit.

They've already lost most of their business and any money they had from it defending themselves when he sued them and lost. Pearson will take their lawsuit against him as high as he possibly can with appeals when he loses, and that's going to cost a fortune, and even then they could still lose the appeal at the very end.
Sucks to seek justice in that sort of scenario even if you think it's a sure thing.

This is simple to offset. The loser pays the sum total of defence *and* prosecution costs--to the other party.

I did like the idea of loser-pays for suits that are ruled frivolous. That would work better. Having loser-pays built into the system just gives too much room to exploit it, though.
I must add that this case caused enormous damage for the image of the USA in South Korea. What miserable man.

I'm disappointed only in that he isn't being made to compensate those poor people for all the harm he did them, financially and personally. He is a sick, sad man and I hope the rest of his life is spent hopeless and miserable while the Chungs enjoy happiness from now on.
Along the lines of 'loser pays', he should have to pay the Chung's legal fees, AND a judgment equal to what he sued for. IOW, he should have to pay THEM the $54 million. That would discourage frivolous lawsuits.

If this guy is so passionate about his dry cleaning, he should open up his own shop and see just how easy it is to meet his own standards. That's about the only living he'd be allowed to make after this; I'm sure that a psych evaluation would quickly prove that he is unfit to practice law in any way, shape or form, and I doubt any employer would willingly hire this whackjob.

Ya know, what's fair is fair here.
Not only do I think that when he has finally exhausted all appeals he should be forced to pay the Chung's legal fees, pain and suffering, Emotional distress, and harassment. swift penalty for slander and bringing about a frivolous lawsuit, he should also be forced to buy back the 2 stores the Chung's lost in all this mess. An immediate lifetime restraining order should be issued preventing him from ever coming within 500 FT of them or their property, and he should never ever be allowed to practice law again. Clearly he has no handle on the law and how it was designed to work. And last but not least, he owes the tax payers money...he should be forced to repay every single dime of the trial and so on.

Don't most dry cleaners pay to replace a damaged item? They should have offered to pay him what it was worth. Case closed.

I think the courts would see this as harassment and force him to pay back the thousands of dollars it has cost the Chungs in legal fees and restore them to a pre-lawsuit status. (get their two stores back.)
